-16-
XV. Mine Facilities, Coal Handiin Struct
Rules 2.05.3 3 2.05.3 7 and 4.04

port Facilities -
There are no substantive differences between the Federal and State
permanent programs in this section.
CYCC has made several revisions to the location of powerlines within the
permit area. Map 34 shows powerlines as they existed when the
application was first submitted; it does not include Eckman Park. The
Division finds therefore, the Map 34 must be revised to include all
powerlines within the permit area and designating whether or not they are
constructed for raptor protection.
This section will be in compliance when a revised powerline map for the
permit area is submitted.
XVI. Roads - Rules 2.05.3(3) and 4.03
There is a difference between the Federal and State permanent regulatory
proyrams. The difference is the designation of roads. Federal
regulations refer to Class I, II and III roads whereas the State
regulations designate haul roads, access roads and light use roads. The
performance standards and design requirements do not differ. CYCC has
submitted revised P1aps 35 and 36 which reflect the redesignations as
required by the State program.
This section is in compliance.
XVII. Bonding - Rules 2.05.4(2)(b) and 3
There are no substantive differences between the Federal and State
permanent programs in this section.
Rule 3.02.2(4) requires that the bond be reviewed at least every two and
one half years. The bond was originally calculated for only the 1980
disturbances. At the end of 1980, a revised calculation was submitted to
cover reclamation costs for the remainder of the permit term. The
original bond was in the amount of three million dollars. Reclamation
costs calculated as of December, 1980 were $2,857,000.00. The operator
suggested that the original bond be maintained and continue to be used
for the remainder of the permit term.
Since the reclamation bond was calculated in December, 1980, there have
been several changes in the application which have an effect on the
reclamation costs. Among these are the permitting of the Foidel Creek
mine which is bonded separately, and a revised mine plan in Area 60,
revised permit boundaries and the construction of new haul roads. CYCC
has not addressed reclamation costs in their revision requests. Also,
the cost of removing structures and reclamation in facility areas was not
included in the original bonding cost. Therefore, it is necessary to
reevaluate the bond based on the current status of the permit application.
