Mine Facilities, Coal Handiin Struct <br />Rules 2.05.3 3 2.05.3 7 and 4.04 <br /> <br />port Facilities - <br />There are no substantive differences between the Federal and State <br />permanent programs in this section. <br />CYCC has made several revisions to the location of powerlines within the <br />permit area. Map 34 shows powerlines as they existed when the <br />application was first submitted; it does not include Eckman Park. The <br />Division finds therefore, the Map 34 must be revised to include all <br />powerlines within the permit area and designating whether or not they are <br />constructed for raptor protection. <br />This section will be in compliance when a revised powerline map for the <br />permit area is submitted. <br />XVI. Roads - Rules 2.05.3(3) and 4.03 <br />There is a difference between the Federal and State permanent regulatory <br />proyrams. The difference is the designation of roads. Federal <br />regulations refer to Class I, II and III roads whereas the State <br />regulations designate haul roads, access roads and light use roads. The <br />performance standards and design requirements do not differ. CYCC has <br />submitted revised P1aps 35 and 36 which reflect the redesignations as <br />required by the State program. <br />This section is in compliance. <br />XVII. Bonding - Rules 2.05.4(2)(b) and 3 <br />There are no substantive differences between the Federal and State <br />permanent programs in this section. <br />Rule 3.02.2(4) requires that the bond be reviewed at least every two and <br />one half years. The bond was originally calculated for only the 1980 <br />disturbances. At the end of 1980, a revised calculation was submitted to <br />cover reclamation costs for the remainder of the permit term. The <br />original bond was in the amount of three million dollars. Reclamation <br />costs calculated as of December, 1980 were $2,857,000.00. The operator <br />suggested that the original bond be maintained and continue to be used <br />for the remainder of the permit term. <br />Since the reclamation bond was calculated in December, 1980, there have <br />been several changes in the application which have an effect on the <br />reclamation costs. Among these are the permitting of the Foidel Creek <br />mine which is bonded separately, and a revised mine plan in Area 60, <br />revised permit boundaries and the construction of new haul roads. CYCC <br />has not addressed reclamation costs in their revision requests. Also, <br />the cost of removing structures and reclamation in facility areas was not <br />included in the original bonding cost. Therefore, it is necessary to <br />reevaluate the bond based on the current status of the permit application. <br /> <br />
