<br />-15- <br />The State permit approval stipulated that: <br />Energy Fuels Corporation will submit a recia~nation plan for the <br />C16284 area (Area 1) after the site is inspected by Mined Land <br />Reclamation Division representatives. <br />An inspection was conducted on May 14, 1980. The primary concern <br />identified during the inspection was slope stabilization for two reasons, <br />the possible accumulation of moisture within the pit adjacent to the low <br />wall and the steep slope situation on the northeastern end of the <br />reclaimed pit. A backfilling and grading plan was approved after the <br />applicant supplied additional information addressing concerns that were <br />identified from the inspection. <br />During the past couple years stabilization of Area 1 has been noted as a <br />problem in inspection reports. Rills and gullies have been observed as <br />well as a slump. Rills and gullies have been repaired for the most part, <br />however, there is one over five feet deep in the upper portion. This <br />gully serves as a collection ditch for all the runoff in the upper Area <br />1. There are no plans in the permit application proposing a <br />stabilization plan for the channel. A stabilization plan must be <br />proposed for this. <br />The slump in the lower part of Area ~ was repaired by the operator, but <br />the Division is requiring monitoring of the area to determine whether the <br />slide mass has been stabilized. CYCC has committed to monitor the site <br />using a series of monument survey lines. Two sets of three monument <br />markers will be placed in the slump area. An annual survey will be <br />undertaken after runoff has stopped. If movement is detected, increased <br />monitoring will be done to determine its potential for mass movement. <br />Monitoring will be done for a minimum of five years. The Division <br />directs CYCC to submit the results immediately following each annual <br />survey. If remedial work is necessary the Division shall be consulted. <br />CYCC revised the mine plan for Area 60. The revised plan included <br />disposing the boxcut material into an adjacent draw. A material balance <br />was submitted which demonstrated that the material is excess. <br />CTL/Thompson, Inc. prepared for CYCC, a slope stability analysis <br />projecting a static slope safety factor in excess of 5.3. This exceeds <br />the required 1.5, thus the revised plan is in compliance with Rule 4.09. <br />There are two excess overburden stockpiles at the Eckman Park mine. Both <br />are very close to completion, except for re vegetation and construction of <br />the permanent diversion ditches around them. Engineer certification of <br />the pile construction verifies they have been constructed according to <br />the approved design plans. <br />For this section, the Division finds that the rilling and gullying <br />stabilization plan must be revised. The remainder of the section is in <br />compliance. <br />
