TSS Daily: <br />4/19/82: Alleged violation is vacated (storm ex- <br />emption). <br />X. Discharge Point 10 (corresponds to CYCC Mine 3 Pond A) <br />A. Verification of construction of this pond has not yet <br />been submitted, because a pond has not yet been con- <br />structed at this site. This discharge point (as well <br />as discharge points 11 through 15, inclusive) is part <br />of a mining permit application currently pending before <br />MLRD. The mining permit was applied for in February, <br />1981. The sedimentation control plan, part of that <br />mining permit application, has not yet been accepted by ~ Cyr <br />MLRD, primarily because of concerns regarding placement'bf ~l <br />of the pond in an alluvial valley floor. MLRD's con- p ~ <br />cerns do not relate to any design criteria or standard ~~~ <br />required by the NPDES permit. The Division has ap-~ <br />proved CYCC's design for all of these ponds. , <br />CYCC has consulted with MLRD regarding the most expedi- <br />tious method of obtaining approval of its sediment con- <br />trol plan for Mine 3. Based on those discussions, CYCC <br />has requested that MLRD approve the sediment control <br />plan separately, as a technical revision ("TR") to the <br />mining permit currently in effect covering areas adja- <br />cent to Mine 3. If approved, the TR will allow con- <br />struction of but one pond for Mine 3, to be located atC °~4 ~ <br />discharge point 14. The other discharge points relat- ti,~~ ~`^~ <br />ing to Mine 3 (points 9 through 13 and 14 through 17) <br />will be deactivated. Construction of the pond at dis- ~'~~~! <br />charge point 14 will be commenced immediately following <br />MLRD's approval of the TR, unless extraordinarily sev- <br />ere winter weather prevents immediate commencement. <br />See also paragraph XIX.F below. <br />B.
