The Regulatory Authority directs Bear Caal Company to submit, for review . and approval by the Regulatory Authority, proposed locations and construction specifications for the three monitoring stations to be installed upon the backfilled material at the Bear Na. 2 portal area. Immediately fallowing the completion of backfilling and grading of the Bear 40. 2 portal area, these three monitoring stations shall be installed as specified and surveyed. Sur- veying of these stations shall be repeated on a semi-annual basis for a period of two years. Results of the surveying of these stations shall be submitted to the Regulatory Authority within 30 days following completion of the semi- annual survey. If monitoring of the backfilled area detects movement, which the Regulatory Authority determines to represent an indication of imninern: hazard, the Bear Coal Company shall expeditiously develop and implement, fol- lowing the Regulatory Authority's approval, a plan to mitigate that hazard and to stablize the backfilled areas. 8. The Regulatory Authority direc'.s Bear Coal Company to perfor-n Proctor testing to determine the moisture-density relations of the materials to be utilized in backfilling the Bear Na. I and No. 2 mine portal areas and submit the rESUit to the Regulatory Authority. In conformance with the recommenda- tions of Rocky 4auntain Geotechnical, Inc., the materials shall be placed and compacted to achieve 95~ of the maximum proctor density, as determined in accordance with AS174 standard TEST 0-648. Further, Bear Coal Camparry shall submit a certified inspection report to verify completion of backfilling and grading of the Bear No. 1 and No. 2 mine partai areas in conformance with the aoproved plan. This mortified apart shall be prepared by a qualified regis- • tered professional engineer or professional geologist. The report shall be submitted to the Regulatory Authority within 60 days of the completion of l backfilling and grading. 4. The Regulatory Authority directs Bear Coal Camparty to submit a detailed engineering plan for the portal access road and portal facilities at the Bear No. 3 Mtne, for review and approval by the Regulatory Authority, no later than 30 days fallowing approval of the permanent program permit. This detailed engineering plan shall include road and portal cross-sections, road and portal plan and grade design drawings, and detailed engineering design drawings for all retaining structures and drainage facilities. No additional disturbance shall occur in the area of the portal access road or portal facilities until these detailed engineering plans have been reviewed and approved by the Regu- latory Authority. i0. The Regulatory Authority directs Bear Coal Company to submit the locations and construction specifications for monitoring facilities designed to monitor the stability of the portal access road and portal facilities at the Bear No. 3 !line. These monitoring facilities shall consist of appropriately located tilt me*_ering and location monitoring facilities. inese facilities shall 'x designed to monitor both the operational and reclaimed configurations of the poral access road and portal facilities.
