'+lithin one month of permit issuance, the permittee will submit a plan for placement and storage of all non-coal wastes in a designated portion of the permit area to ensure that leachate and surface r,~naff do not degrade surface or ground water. A plan for final disposal of non-coal wastes in a designated disposal site will also be suhmitted. 12. Within one month of permit issuance, an operation description, a sediment control plan, and a reclamation plan far the loadout will he incorporated into the permit. 13. 'Within two months of permit issuance, the permittee will submit far the approval of the Regional Administrator to the Regulatory Authority an accept- able plan for snow removal and disposai, to insure that snow and road surfac- ing material is disposed of in an appropriate area, and does not interfere with surface drainage. 14. The Regulatory Authority directs Bear Caal Company to submit a subsidence monitoring program for review and approval by the Regulatory Authority. This program shall include the installation of appropriate profile lines of perma- nent monumenrts, capable of resisting normal traffic and meteorological phenom- ena. Monumetrts shall be located t0 monitor possible subsidence of areas des- ignated for the initiation of retreat or secondary extraction. These plans shall include a typical manumerrt detail drawing. This subsidence monitoring program shall be submitted, for review by the Regulatory Authority, within 30 days failowinq permit approval. Further, the approved subsidence monitoring • monuments shall be installed and initially monitored prior to the commencement of retreat or secondary extraction within the Bear No. 3 mine. Following the initial monitoring, the subsidence monuments shall be monitored an a semi- annual basis, and the results of that monitoring shall be submitted to the Regulatory Authority within 30 days follaaing completion of eaw monitoring su rvey. 15. If previously undisturbed areas are to be impacted by mining ar related activities (roads, power lines, subsidence etc.) a cultural resource inventor/ must be performed prior to this impact. Sites are located by this su r~ey. They must be evaluated far eligibility to the National Register of historic ?laces and if they are found to be eligible, a suitable mitigation plan must be developed by the company and approved by the State Historic Preservation Officer (SHPO) and the Office of Surface Mining prior to the distur'oance.
