,m <br />-26- <br />It has been determined, based on information presented in the permit application, <br />the 1982 Rental Rate Blue Book, the Caterpillar Performance Handbook Edition ZI, <br />and the 1982 Pfeans Building Construction Cost Data Book, that the performance bond <br />for the Trinidad Basin Miae shall be in the amount of $327,000.00. She Division <br />has determined this amount to be sufficient to cover the costs of reclamation <br />should it be necessary for the State to undertake reclamation at the site. <br />Pursuant to Rules 2.07.6(2)(j) and 3.02.1(1), the performance bond will be filed <br />with the Division, payable to the State of Colorado, prior to permit issuance. <br />XXI. Sealing of Drilled Xoles and Underground Openings - Rules 2.05.9(2)(q) <br />and 9.07 <br />The Division has reviewed Section 4.07 o.f the permit application and PAR response <br />for compliance with the Rules and Regulations. <br />The applicant has committed to the sealing of alI exploratory holes and monitoring <br />wells which will not be immediately mined through. Sealing will be with cuttings, <br />cement, and a suitable plug. Holes intercepting aquifers will be completely sealed <br />with cent slurry. A11 hole Locations will be marked. <br />The operation is in compliance with the requirements of this section. <br />XXII. Special Categories of Mining Othar Than AVF and Prime Farmland - <br />Rules 2.06, 4.22, 4.23, 4.26, 4.27 and 9.29 <br />The Trinidad Basin Mine has two areas of the mining operation which are covered <br />by these Rules; Auger Alining (Rule 4.23), and Operations on Steep Slopes (Rule <br />4.27). <br />The Division has reviewed Sections 7.I8 (page VII-23), 6.2 (pages VI-3 - VI-4), and <br />5.3 (pages V-5 - V-20) for compliance with the requirements of the applicable <br />sections of the Regulations. <br />Trinidad Basin Mining Company proposes to auger mine contemporaneously following <br />contour pit surface extraction at the Trinidad Basin Mine. Their plan is found <br />to be in compliance with the requirements of the permanent program regulations. <br />The majority of the Trinidad Basin Mine contour strip mined permit area comprises <br />a "steep slope mining" area, in the opinion of the Division. The material <br />analyses and stability analysis contained within the amended application documents <br />demonstrate the operator's plan to be in compliance with the performance standards <br />and design standards of the permanent program regulations. <br />The operation is in compliance with the requirements of this section. <br />XXIII. Miscellaneous Compliance - Rules 2.05.6(5), 4.02, 4.12, 4.19, 4.21, 4.28 <br />and 9.30 <br />The Division has reviewed the permit application for compliance with the above <br />sections. Information pertinent to these sections can be found in Sections 7.I <br />(page VII-1), 7.9 (page VII-13), 7.16 (page VZZ-23), Exhibit V-2, 5.3 (page V-18), <br />7.17 (page VII-23), 7.I9 (page VII-24), 6.3 (page VI-6), and 7.20 (page VII-24) <br />of the permit application and Section 2.06.70 of the PAR response. <br />
