0 <br />-27- <br />The operation is in compliance with the requirements of Rules 4.02 and 9.12. <br />With respect to Rules 2.05.6(5} and 4.1 !), the Trinidad Basin Mine is within 500 <br />feet of abandoned underground workings from past coal mining activities. The <br />applicant has obtained permission from MSRA to mine within 500 feet of these <br />workings. The Division hereby approves the nature, timing, and sequence of mining <br />operations and finds the operation in compliance with the requirements of these <br />sections. <br />The operation is in compliance with the requirements of Rule 4.21. <br />The applicant operates a coal loadout in the city of Trinidad, Colorado. The <br />operations and reclamation plan for this site was previously reviewed and approved <br />by the Division as a revision to Permit No. 79-53. The review and approval were <br />based upon the requirements and performance standards of C.R.S. 34-33-101 et seq. <br />and the current Rules and Regulations. <br />The applicant has readdressed the Ioadout in the current application, but has not <br />incorporated the previous revision materials which were submitted and approved. <br />it is, therefore, a stipulation that: <br />Stipulation No. 18: <br />THE PERMI TTEE ZS REQUIRED TO IMMEDIATELY INCORPORATE ALL PREVIOUSLY <br />APPROVED SUBMITTALS REGARDING THE TRINIDAD LOADOUT FACILITY INTO <br />THIS PE~1IT DOCUMENT, AND IS BOUND TO FOLLOGJ THE OPERATION AND <br />RECLAMATION PLAN PREVIOUSLY APPROVED BY THE DIVISION. <br />The operation is in compliance with the requirements of Rule 4.30. <br />XXIV. Operations on Lands Subject to Limitations or Prohibitions - Rules 2.03.7 <br />and 2.10 <br />The operation is in compliance with the zequirements of these sections and Rule <br />2.07.6(2)(4) for the following reasons: <br />A. The permit area of the operation is not within: <br />1. An area designated unsuitable for surface coal mining operations; <br />2. An area under study for designation as unsuitable for surface coal <br />mining operations; <br />3. The boundaries of any National Park, Wildlife Refuge System of Trails, <br />Wilderness Preservation System, Wild and Scenic Rivers System, or <br />Recreation Area; <br />4. Three hundred feet of any public building, school, church, community <br />or institutional building or public park; <br />5. One hundred feet of a cemetery; or <br />6. Any Federal lands. <br />
