to be backfilled from the 720 stockpile to the 720 Pit, and completion of Pit 1 <br />backfilling concurrently during the final two years of backfilling in the 720 Pit. <br />Recent correspondence concerning backfilling/reclamation schedule includes a <br />1 /12/93 letter from Energy Fuels Coal, Inc. to DMG discussing the backfilling <br />requirements found in the Permit Renewal Decision Document on page 12 <br />(paragraph 4, 5th sentence) which is reitterating the currently approved permit <br />language discussed above requiring backfilling of the 720 Pit at a rate of 1.0 <br />million cubic yards per year. The 1/12/93 letter also requests the DMG to <br />modify the existing Permit and reduce the required backfilling rate. We <br />expressed to all parties during the inspection that any reduction in the currently <br />approved backfilling rates would be inappropriate. PR-1, to mine Pit 2, has been <br />withdrawn by the permittee and it does not appear it will be resubmitted given <br />current coal market conditions in the area, etc. AFO feels the currently <br />approved backfilling rates are the minimum necessary to ensure <br />contemporaneous reclamation of the disturbed areas. <br />DMG has issued NOV C-93-021 for faliure to maintain required records at the <br />mine. Missing records included: Map Exhibit 28A to the approved TR-09 ;the <br />renewed NPDES Permit ;current bonding document ;and revisions TR-07 and <br />TR-08. <br />Additional notices of violation issued by DMG based on our field observations <br />
