• (Page 31 • <br />MINE ID # UR PROSPECTING ID # <br />INSPECTION DATE 10/5/95 <br />M92-054 <br />INSPECTOR'S INITIALS WHE <br />On 10/10195, DMG was contacted by Mr. Walter Bump. The permit application states that Mr. Bump is the landowner of the mine <br />site as well as the lands surrounding the permit area. Mr. Bump indicated that he was the landowner and that he was installing the <br />irrigation pipe line on his property. Mr. Bump stated that the equipment parked at the mine site was his and that he was utilizing <br />stockpiled material from the mine site in accordance with an agreement between the operator and himself. Mr. Bump also indicated <br />that his dozer was responsible for the dozer road which extends from the northeast corner of the permit area across La Boca Canyon. <br />DMG inspector informed Mr. Bump that DMG was concerned that his activities may adversely impact successful completion of <br />reclamation at the mine site. Mr. Bump also indicated that he had excavated alluvial material from Le Boca Canyon for use in laying <br />the irrigation line. Mr. Bump inquired if his activities required a permit from DMG. DMG inspector replied that a mining and <br />reclamation permit was not necessary for landowners who are excavating construction materials from their own land, for their own <br />use on their own land (Rule 1.2.21611, but if material was sold or hauled off-site then DMG would require a mining and reclamation <br />permit. Mr. Bump also indicated that he was interested in applying for a succession of operator for the existing permit M-92-054, <br />to become the operator. <br />Section 34-32.5-119 of the Colorado Land Reclamation Act for the Extraction of Construction Materials states, <br />When one operator succeeds another at an uncompleted operation the Board shall release the first operator <br />from ell liability as to that operation and shall release all applicable performance and financial warranties <br />as to such operation if the successor operator assumes all liability for the reclamation of the affected land <br />and such obligation is covered by appropriate performance and financial warranties. The fee specified in <br />Section 34-32-12712) shall be paid to the Board by the successor operator before the first operator is <br />released from liability and before any financial warranties are released. <br />Section 34-32-127121 of the Colorado Mined Land Reclamation Act, 34-32-101 ET SEQ., C.R.S., states that the fee for succession <br />of operator shall be S 100.00. <br />Requirements for permit transfers and succession of operators is addressed by Rule 1.12 of the Mineral Rules and Regulations of <br />the Colorado Mined Land Reclamation Board. <br />1.12.1121 Requests for permit transfers and succession of Operators must be submitted on "Request for Transfer of <br />Mineral Permit and Succession of Operators" forms provided by the Board. Each request must include an <br />executed Performance Warranty and applicable replacement Financial Warranty. <br />1.12.113) Approval of a permit transfer and succession of Operator request shall be given by the Office if it finds that <br />the successor Operator is capable of assuming all responsibility for the conditions included under the <br />original permit... <br />Copies of "Request for Transfer of Mineral Permit and Succession of Operators" application package (11 pages) ere included with <br />this report to the operator and to Mr. Bump. The existing permit M-92-054 is for reclamation only, no aggregate extraction is <br />approved under the conditions of permit M-92-054. As such, if Mr. Bump desires to execute permit transfer and succession of <br />operator for excavation of construction materials, Mr. Bump will be required to submit a reclamation permit amendment with a map <br />and an application with the same content as required for an original application as required by Section 34-32.5-110171 of the <br />Colorado Land Reclamation Act for the Extraction of Construction Materials.
