III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />Upstream to the south of the "A" Pit graded area, Channel 006-51 is culverted beneath <br />the inactive eastern segment of Haul Road "A". A short distance further upstream from <br />the culvert, the drainage has been diverted by a temporary diversion ditch that was <br />maintained while there'were active open pits in the "A" Pit mining area. The diversion <br />is no longer functional, and in fact has breached in one location directly south of the <br />referenced culvert. The gully caused by this breach was one of the locations cited in <br />NOV CV-2003-014. The remnant section of the diversion needs to be eliminated to <br />restore the original drainage flow dawn the 006-S1 channel. The entire length of the <br />diversion from the 006-S1 channel to the gully headcut needs to be graded over. This <br />work needs to be completed prior to or in conjunction with backfilling of the gully <br />immediately upgradient from the "A° Road Culvert (abatement deadline May 19, 2004). <br />New Sediment Pond 016A has tilled very rapidly this spring, and water level was full to <br />within 6" of the top of the spillway riser. There was a trickle of clear water dripping <br />from the primary spillway outlet. If there is an increase in the quantity of leakage <br />through the spillway, the source of the leak will need to be investigated and appropriate <br />corrective measures will need to be taken, <br />The french drain in the location of the failed wells below the Pond O16A embankment <br />appeared to be functioning properly, with clear flow from the well location being <br />directed into Pond 016 via the french drain. Later this spring, the operator plans to pull <br />out the damaged well casings and pump concrete down the holes to seal the wells. <br />There was no indication of new ground movement this spring in the immediate vicinity, <br />arid no indication of 016A embankment instability. <br />The in-slope slumps described in previous inspections have not yet been repaired. The <br />extent of any additional movement since the previous inspection could not be <br />determined with certainty. The toes of both slumps are now submerged beneath the <br />impounded water, so the pond storage capacity would appear to have been impacted to <br />some extent. The scarp of the larger (northern) slump is within a few feet of the <br />adjacent haul road at its highest point. Byron Walker, DMG staff engineer, will inspect <br />these slides and various other slides within disturbed portions of the permit area later <br />this month. <br />Riprap beneath the outlet of the large culvert IJ-2) at the northeast corner of the pond <br />has been dislodged and repair is necessary. <br />Grass seeded last fall has recently germinated on the slopes of the embankment. <br />However, the top of the embankment was built up with an additional 6 inch lift, and <br />was apparently not subsequently seeded. Top of the embankment needs to be seeded <br />with the stabilization seedmix. <br />
