III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />Pond 016 was full, with water spilling over the top of the spillway riser. Discharged <br />water was clear, approximately 40 gpm, roughly equivalent to the flow volume out of <br />the french drain. There were beaver holes along the north side of the pond and one <br />hole started into the embankment near the spillway riser. The beaver needs to be <br />removed and the hole in the embankment repaired. <br />There was a relatively recent scarp 12"-18" high in the slide area on the slope above <br />the southeast end of the pond. The scarp is approximately 30' to 40' from the upper <br />limit of the "brush line", which is the area that has been graded in the past. This slide <br />area will be inspected by the DMG engineer later this month. <br />Pond 17 was also full, spilling over the top of the primary riser, and discharging clear <br />water. There were fresh beaver slides and cuttings at Pond 17 also. The beaver may <br />need to be removed if its activities affect spillway functioning or integrity of the <br />embankment. <br />A temporary ditch/berm-had been constructed late last fall to route disturbed area <br />drainage from the active Wedge pit, spoil, and topsoil stripped areas along the light use <br />road and into Pond 017, rather than allowing disturbed runoff to enter Hubberson Gulch <br />upstream of the pond. The temporary measure appears to have been relatively effective <br />in diverting disturbed drainage away from the gulch, but there were breaches in a <br />couple locations that need to be repaired promptly. There was no designed collection <br />ditch specified for this location in the approved permit, but the Division has requested. <br />that such design be provided in the mid-term review, completed in late 2003. <br />~ At Sediment Pond 9, water level was approximately 3 feet below the top of the primary <br />riser, and there was no discharge. <br />Sediment Pond 15 was full and spilling over the top of the primary riser. Discharge <br />water was clear, There were signs of recent beaver activity but the spillway was not <br />obstructed and there were no excavations of the embankment. The beaver may need to <br />be removed if its activities affect spillway functioning or integrity of the embankment. <br />Backfiiling and Gradinsl <br />"D" Pit Area <br />~ Final grading including drainage channel construction has been largely completed in the <br />"D" Pit disturbance areas. <br />~ Repairs are necessary on the steep lower segment of Drainage Channel 005-E7. <br />Grading and riprap replacement will be necessary to restore the design channel in <br />
