III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />• There is a segment of Haul Road "A" beyond the Haul Road "H"junction that is no <br />longer actively used. Within TR-45, currently under review, the operator has proposed <br />that this road segment would be modified for postmine use as a segment of the <br />permanent Ridgeline Access Road. If approved, this road segment will need to be <br />partially reclaimed, with roadbed width reduced and cutslope partially backfilled. The <br />existing 36" culvert beneath the road fill across Drainage 006-S1 would logically be <br />retained for the permanent road. This culvert is not depicted on current or TR-45 <br />version of Exhibit 13-2, Surface Hydrology. The map exhibit will need to be properly <br />updated to include the culvert. This item will be included in the Division's adequacy <br />review letter for TR-45. <br />• A haul truck had recently tipped over and a small amount of coal had spilled over the <br />road berm onto the fill slope near the outlet end of culvert K4 (the southern-most Haul <br />Road "K" culvert). The coal spillage needs to be properly cleaned up. <br />0 Grass seeded last fall on "K" Road cut slopes had very recently germinated in most <br />areas. <br />Necessary maintenance work along the southern-most segment of the Haul Road "K" <br />corridor was described in the Division's November 2003 complete inspection report. <br />Due to seasonal constraints, the work has not yet been conducted. Specifically, the <br />slope immediately down gradient from the toe of the road fill along the lower most <br />segment of the road had been stripped of topsoil, but had not been graded or seeded <br />and some rill erosion had initiated. A small amount of topsoil remains adjacent to this <br />area within a designated temporary stockpile. It is recommended that the slope area ba <br />properly graded, the remaining topsoil from the temporary stockpile be respread over the <br />slope, and the entire area be seeded with the stabilization seedmix. This work should <br />be completed by the end of May. <br />Hydrologic Balance <br />Sediment Pond 005 water level was lapping over the top of the riser. There was a <br />trickle of inflow and a trickle of clear discharge. <br />Pond 006 water level was a couple inches below the top of the primary spillway riser, <br />but there was a small flow of clear water discharging from the primary outlet <br />(approximately 10 gpm). Minor seepage appears to have reinitiated at the seam where <br />the most recent spillway extension was attached. The spillway leak needs to be <br />repaired promptly. Inflow to the pond appeared to be in excess of 50 gpm, much of the <br />flow from the graded spoil area was concentrated in the 006-SE1 drainage. <br />The pre-settling basin has been completely eliminated by backfilling of the "B" Pit. <br />
