revision during the week of 8/16 to 20/93 which will request approval of an <br />expansion in the coal handling/storage facilities. According to the permittee, <br />this expansion will involve the elimination of pond MB-2 and the enlargement of <br />ponds MB-3 and MB-6 to facilitate surface water runoff control for the <br />reconfigured area. ); we reviewed the sed. cad. demonstrations for the two <br />approved SAE's on site and both show runoff values less than 0.5 settleable <br />solids.; and we concluded the 8/10 office review with discussions of the 7/93 <br />citizen's complaint and applicability of the steep slope mining provisions found <br />in the approved Colorado Regulatory Program. I referred the inspection <br />participants to various sections of the 12/16/92 Permit Renewal Decision <br />Document which are incongruous with respect to the steep slope mining <br />provisions and A.O.C. variances applied to final reclamation configurations in <br />steep slope mining areas. It appears an A.O.C. variance is being incorrectly <br />applied to final reclamation configuration/post mining land use at the Sylvester <br />Gulch Fan Site. This was discussed with inspection participants. This concluded <br />the 8/10 records review. <br />We began the field inspection of 8/11 at the railroad loadout and continued <br />throughout the facilities areas. Deficiencies for pond MB-4 are noted above and <br />in addition the straw bales in the emergency spillway need to be removed. <br />Stops and observations at the facilities area included :refuse pile area where <br />7 <br />
