annual hydrological reports were briefly reviewed 1 DMG is currently reviewing <br />the 1991 water year report for West Elk Mine. 1 as were the current field date <br />sheets for both surface and ground water monitoring thru 8/5/93; letters <br />documenting public notice of the subsidence control plan were requested and <br />reviewed. The letter provided from the permit which provided notification to the <br />surface land owner above proposed underground workings was dated 12/13/84 <br />and addressed to Grand Mesa Properties. Grand Mesa was notified that mining <br />will commence under their proprey on or about 2/1/85, which does not satisfy <br />the six months prior to mining requirement of Colorado Rule 4.20.2. The letter <br />also did not contain notification of dates of mining activities that could cause <br />subsidence and affect specific structures; and notification of measures to be <br />taken to prevent or control adverse surface effects. In addition, the United <br />States Forest Service (USES) is the surface owner of the SE 1 /4 of Section 20 <br />which has also been undermined, and the USES was not notified as required by <br />the above rule. This violation was discussed with inspection participants and <br />Ms. Johnston issued NOV ! C-93-112 on 8/12/93 to address this violation. The <br />current surface land owners of Sec. 20, which is the only Section undermined <br />to date, include the USES and Mr. Larry Mautz. Mr. Mautz registered a citizen's <br />we P~ <br />complaint which was received by the DMG on 6/7/93, and a citizen's complaint " \ <br />~ ) <br />inspection was conducted by Ms. Johnston on 7/13/93. Mr. Mautz attended ~tyq~ <br />the inspection and complained of interrupted or discontinued spring flow from a ~ ~\ <br />spring on his property.
