<br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />Suooort Facilities <br />Coal waste, stored temporarily, has been pushed over the back of <br />the concrete storage bunkers. This material should be picked up <br />and hauled to the lower refuse pile. MCC has begun to use the <br />hydraulic storage parts building. The former storage location is <br />almost empty with the exception of a few heavier parts. MCC is <br />awaiting the delivery of a hoist for the building before the parts <br />are moved to the new storage location. Once this occurs, <br />contaminated soils in the old location should be removed and <br />disposed of properly. MCC should consider extending the berm <br />around the coal storage at the three stacktubes further to the <br />southwest to ensure that any surface runoff from the coal pile <br />would flow through the silt fence. MCC has experienced some <br />additional water line breaks. As part of the water line <br />improvement project, approved as MR#114, the surface water line <br />will be extended to the office and shop. This additional line can <br />be included with the as-builts and submitted as a minor revision. <br />Ms. Welt informed me that the material storage bench, portal bench <br />and shop/warehouse area are being considered to be surfaced with <br />RCC. A revision should be submitted for this project as well. Ms. <br />Welt informed me that with an increase in their work force <br />additional shower facilities are needed. MCC has purchased <br />trailers for these facilities. A revision should be provided <br />indicating the location of the trailers and any bond estimate <br />increase. <br />Topsoil <br />Grass is beginning to grow on the topsoil pile and pad adjacent to <br />the Lone Pine Gulch substation. MCC is planning to seed the <br />disturbances and topsoil piles located in Lone Pine Gulch before <br />the end of April, weather permitting. Grass is also beginning to <br />grow at the main topsoil stockpile on the mine site. <br />Slides and Damacxe <br />There has been a rotational slump under the main access/haul road <br />at the keystone wall. The wall is still intact and the road is <br />still passable using one lane. Instability has occurred in this <br />area in previous years. MCC has proposed a repair plan which <br />includes a series of french drains, a perforated culvert, and a <br />buttress. Preliminary approval was given to MCC to begin the <br />construction. Final approval is contingent upon the Division's <br />review of the design and stability analysis of the buttress. <br />
