COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />Excess Spoil and Development Waste <br />All the underground development waste which will be placed in the <br />Lone Pine Gulch pile is now on the surface. John Poulous of MCC, <br />who accompanied me and Mr. Barbe during the inspection of the Lone <br />Pine Gulch fan facilities, believes that there will not be as much <br />waste disposed of in the pile as originally permitted. MCC has <br />temporarily stored some refuse on the fan bench. This material <br />should be moved up to the pile as soon as road conditions allow. <br />MCC should also begin constructing the pile in lifts as permitted. <br />The east side of the refuse pile is close to final grade with the <br />exception for some coal refuse that needs to be pushed up on the <br />slope. Wells SG-1 and GP-1 will not be lost as originally thought. <br />The regrading of the coal and replacement of the subsoil and <br />topsoil should proceed as soon as conditions allow. <br />Offsite Support Facilities <br />Work is continuing on the Lone Pine Gulch fan. Both portals are <br />complete. Most of the fan housing has been constructed. MCC is <br />planning to spray Soil Guard on the slope above the fan before the <br />end of May, weather permitting. The contractors, Patrick-Harrison, <br />have temporarily stored fuel and oil at the staging area. Some of <br />the barrels are leaking, but are within a bermed area. When the <br />contractors demobilize, MCC should remove any contaminated soil and <br />dispose of the soil properly. Mr. Barbe indicated he would use <br />absorbants to pick up water in the bermed area. <br />007IN5040595 <br />
