III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />A complete inspection of the West Elk Mine was performed by <br />Christine Johnston of the Division. Please note this complete <br />inspection is for first quarter 1995. Henry Barbe of Mountain Coal <br />Company (MCC) accompanied me during the site inspection. Kathy <br />Welt of MCC was available to discuss future permitting. The <br />inspection took place over two days. The site inspection and some <br />of the records were reviewed on the first day. Records review was <br />completed on the second day (April 6). <br />Availability of Records <br />Records for the West Elk Mine were reviewed at the mine office. <br />Please see the attached form for the records checklist and comments <br />on the records reviewed. The AVS Annual Review Inspection was also <br />completed. <br />Roads <br />The road to the Lone Pine Gulch fan site was generally in good <br />condition with the exception of the north facing side of the road <br />and the section between the fan bench and the underground <br />development waste pile. But in comparison to the previous year, <br />the road is much improved due to the drainage control constructed <br />by MCC. As conditions allow, the road should be regraded so it <br />continues to be passable. <br />Hydrologic Balance <br />Maintenance should continue on the portal bench ditches, <br />particularly D2-7D. As weather conditions improve maintenance <br />should be performed on ditches and culverts as needed. At the time <br />of the inspection the following ditches and culverts were noted as <br />requiring maintenance: D2-4, C2-13A, D2R-lA, D3-2, and D3-3B. MB-4 <br />was cleaned in February and held only a small amount of water. MB- <br />5 was discharged in February. The water level is approaching the <br />principal spillway elevation. The Sylvester Gulch gauging station <br />was inspected. It is located approximately 30-50 feet north of the <br />top of the refuse pile. The flume is located upstream from ground <br />water wells SG-1 and GP-1. Lining of MB-1 is complete and the pond <br />is still in the two cell configuration, which was approved as a <br />temporary design during the lining of the pond. MCC has indicated <br />that they would prefer this configuration to be permanent. I <br />informed them a technical revision would be needed to make this <br />configuration permanent. <br />
