III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />Topsoil <br />Backfill slopes in the portal bench area and waste disposal area (waste cell and cover soil stockpile area) were <br />properly topsoiled during the June/Julyi 2007 reclamation project. The lower road topsoil stockpile was fully <br />used up, and the stockpile footprint area was graded, roughened and seeded with "Quickguard" cover crop. A <br />small quantity of topsoil remains in the waste disposal stockpile site, to be used for final reclamation of the <br />sediment pond site when the pond is filled in. The remaining soil in stockpile was spread out, roughened and <br />seeded with the cover crop. There is also a small remnant pile of cover soil (subsoil) material in stockpile <br />adjacent to the sediment pond that will be used for final backfilling of the pond. <br />Revegetation <br />The "Quickguard" cover crop that was seeded in July on areas that were graded and roughened in association <br />with the reclamation project has recently germinated. In most areas, the grass has produced vegetative growth <br />2" to 4" in height. The stand looks promising in most areas, but growth and density is not yet sufficient to provide <br />appreciable soil protection. A few small locations were observed where it is evident that the cover crop was <br />apparently not seeded, including areas along the outslopes of the portal area lower containment berm, disturbed <br />slopes below the steep segment of the cattle trail, and certain steep outslope locations along the reclaimed road. <br />Operator will need to ensure that these areas are seeded and mulched in association with the <br />permanent seeding this fall. <br />Offsite Suooort Facilities <br />The Loma Loadout was inspected and the following observations were made: <br />Site conditions were dry. Soil surface is stabilized by a mix of winter and summer annuals, as well as <br />perennials including western wheatgrass, seepweed, greasewood, fourwing saltbush, and forage kochia. <br />A small circular disturbance near the west end of the site where knapweed was sprayed last fall <br />is largely bare, and should be reseeded this fall. There is still a small remnant patch of <br />knapweed along the berm immediately southwest of the sprayed area that needs to be sprayed <br />in September. <br />The SAE silt fence is warn and frayed, and needs to be replaced. <br />Miscellaneous Reclamation Notes <br />• Livestock fencing as required by the approved permit in various locations including lower end of <br />the reclaimed road, waste disposal affected area, and lower road topsoil stockpile area, has not <br />yet been initiated. The fencing needs to be completed this fall, to be in place before cattle are <br />turned out next spring. <br />• Segments of the old "elephant trunk" culvert outlets are still scattered along the toe of the slope below <br />the reclaimed portal access road, and need to be gathered up and hauled out for proper disposal. <br />• Wooden power poles are stacked along the lower road, west of the Munger Creek culvert, and will need <br />to be hauled out for proper disposal. <br />6 <br />
