III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />most segment of the haul road (private land segment) has been left "as is", and width reduction reclamation will <br />need to be conducted in conjunction with haul road culvert removal at a later time. <br />Grading, roughening, and seeding with cover crop was completed along the remainder of the portal access road, <br />between the access trail up the North Fork of Munger and the portal bench, in July. There was minor rilling on <br />some slope areas from recent rains, but erosion was not excessive. Riprapped stream channels along the <br />reclaimed road segment functioned well, and remain in good condition. "Quickguard" cover crop had recently <br />germinated along the reclaimed road slopes. <br />Hvdroloaic Balance <br />There have been some rains at the site since the end of July, including at least one storm that generated <br />significant runoff, apparently on the night of August 2 (see discussion under Description of Enforcement <br />Actions). As described, silt fence sediment controls in SAE #1 and SAE #2 on the portal bench area failed, and <br />had not been maintained after the runoff event. <br />The silt fence at the lower road topsoil stockpile reclamation site SAE had functioned properly and was in good <br />condition. The waste disposal area sediment pond contained a shallow puddle in the deepest part of the pond. <br />Ditches, culverts, and berms associated with the reclaimed waste disposal site, cover soil stockpile site, waste <br />area topsoil stockpile site, and lower road topsoil stockpile site had functioned well and were in good condition. <br />East Salt Creek and Munger Creek were dry at the time of the inspection, but there was evidence that both <br />creeks, as well as smaller ephemeral tributaries had recently flowed. <br />There was minor rill erosion from concentrated flow along Channel "H" berms as noted previously, as well as <br />rilling and short gullies on channel slopes and hillslopes below failed silt fence locations. <br />Along steep segments of the cattle trail below the bench, water bars had partly silted in, and should be <br />built up. <br />Backfill and Gradin <br />Backfilled slopes along the access road and in the portal area held up well, with only minor rill erosion in some <br />areas, most concentrated along lower slopes in the portal area and along some of the long slopes adjacent to <br />permanent channels along the reclaimed road. Riprapped permanent drainage segments functioned well, with <br />no evident erosion or siltation along their length, or at inleUoutlet locations. One non-riprapped channel along <br />the reclaimed road between Channel "A" and "A1" is rilled along its lower end, and will require <br />maintenance if it does not stabilize. A similar situation was noted along anon-riprapped channel <br />located along the reclaimed road between riprap Channels "G" and "EIF". <br />There were no indications of slope instability (cracking, slumping, etc.) along the reclaimed road or on backfill <br />slopes in the portal area. <br />Processino Waste <br />The waste disposal site (including the waste disposal cell and adjacent cover soil and topsoil stockpiles) has <br />been fully reclaimed, with the exception of seeding with the permanent seedmix, to be conducted in the fall after <br />October 15. Replaced topsoil was extensively roughened and seeded with the "Quickguard" cover crop, which <br />has recently germinated. No problems were evident; the site appears stable with no appreciable erosion. <br />5 <br />
