IV. ENFORCEMENT ACTIONS <br />The following identifies enforcement actions taken during this inspection, the required abatement and <br />date of abatement for the violation, previous violations still requiring abatement and the termination of <br />violations cited during previous inspections. <br />NOV CV-2007-003 was issued as a result of this inspection. Refer to "Description of Enforcement Actions" <br />section of this report for discussion of the nature of the violation and pertinent information regarding the <br />enforcement action. Required abatement items and dates for abatement are as follows: <br />STEPS NECESSARY TO ABATE VIOLATION (REMEDIAL ACTION): <br />t) Replace or repair the five failed silt fence structures and install additional silt fence segments as <br />necessary to minimize flow concentration to individual silt fence structures and ensure proper <br />functioning. Install at least two additional silt fence segments along each of the channel berms on the <br />east and west sides of Channel "H", with corresponding berm breaks and water bars as necessary to <br />direct flow through the silt fenced berm breaks. Complete Remedial Action Item 1 by 8130/07. <br />2) Construct berm break and water bar as necessary to direct flow of ephemeral channel into Channel "H", <br />at location near upper end of lower riprapped segment of Channel "H", where a small tributary channel <br />enters the disturbed area from the west. The channel was diverted to flow along the berm rather than <br />into Channel "H", which may have contributed to the failure of the SAE-#2 silt fence. Complete <br />Remedial Action Item 2 by 8/30/07. <br />3) Submit a properly amended Appendix page M(viii)-1 iv, showing additional silt fence and berm break <br />locations, within the technical revision application associated with permit renewal.
