. .~ <br />IV, Enforcement Actions <br />The following identifies enforcement actions taken during this inspection, the <br />required abatement and date of abatement for the violation, previous violations <br />still requiring abatement and the termination of violations cited during previous <br />inspections, <br />Enforcement Concerns: <br />As a result of this inspection 3 Notice of Violations were Issued to this mine for <br />records, roads and hydrology problems; these were NOV C-93-027, NOV C-93-022 <br />and C-93-029 respectively. <br />NOV C-93-021 was issued for failure to maintain required records at the mine <br />site. <br />Records were checked, the following required items were missing. <br />1) Map 28A shows the revised permit boundary approved during TR-09. <br />2) The NPDES permit had expired in June and there was no <br />correspondence from the Heath Department concerning a renewal. <br />3) The current bonding document was missing. <br />4) Revisions TR-07 and TR-08 were missing. <br />5) The findings document issued with the proposed decision to renew. <br />Some of these items (1, 4 and 5 could be found at the ACZ Lab office In <br />Steamboat Springs. But, the Mine must maintain records on site as required In <br />Rule 5.02.4. <br />5.02.4 Availability of Records. <br />122(8) (1) Copies of all records, reports, Inspection materials, or <br />information obtained under these Rules by the Divlslon or Board, <br />except information identified as confidential, shall be immediately <br />available to the public at the Divlslon office and at a convenient <br />place in the area of mining to which the Information pertains until at <br />least five years after expiration of the period during which the <br />subject operation Is active or is covered by any portion of <br />reclamation bond, <br />Abatement: Kerr Coal will update the records to Include the referenced missing <br />records and any other missing records before April 26, 1993. <br />Marr Strip <br />3 <br />April 6, 1993 <br />NOTE: Attach appropriate VIOLATIONS OR CESSATION ORDER CODING FORMS <br />Revised: 4/88 <br />Doc.
