IV. Enforcement Actions <br />The following iaentifies enforcement actions taken during this inspection. the <br />required abatement and date of abatement for the violation, previous violations <br />still requiring abatement and the termination of violations cited during previous <br />inspections. <br />"Each access road shall be designed, <br />constructed, or reconstructed, and <br />maintained to have adequate drainage, <br />using structures, such as, but not limited <br />to, ditches, cross drains, ditch relief <br />drains, culverts and bridges. The <br />water-control system shalt be designed to <br />safely pass peak runoff from a 10-year, <br />24-hour precipitation event or a greater <br />event if required by the Division." <br />Abatement- <br />A revision shall be submitted with designs <br />for a ditch and culvert on the east side of <br />the access road designed to handle the <br />anticipated flow. The culvert at the inlet <br />will be repaired and erosion around this <br />area also will be repaired. The 6 inch <br />culvert that drains the wet area on the <br />mine access road and the one at the <br />loadout need to be permitted (see attached <br />NOV form). This revision must be <br />submitted before April 26, 1993. The <br />revised design shall be constructed no <br />later than May 31, 1993. <br />NOV C-93-029 was issued for failure to <br />have anon-clogging dewatering device. <br />Figure 2 Access Road <br />Sediment pond E was approximately 1.5 <br />feet from discharging through the top of the principal spillway. The pond was <br />not dewatering through the sized orifices to maintain a 10 year 24 hour storage <br />capacity.
