IV. Enforcement Actions
The following iaentifies enforcement actions taken during this inspection. the
required abatement and date of abatement for the violation, previous violations
still requiring abatement and the termination of violations cited during previous
inspections.
"Each access road shall be designed,
constructed, or reconstructed, and
maintained to have adequate drainage,
using structures, such as, but not limited
to, ditches, cross drains, ditch relief
drains, culverts and bridges. The
water-control system shalt be designed to
safely pass peak runoff from a 10-year,
24-hour precipitation event or a greater
event if required by the Division."
Abatement-
A revision shall be submitted with designs
for a ditch and culvert on the east side of
the access road designed to handle the
anticipated flow. The culvert at the inlet
will be repaired and erosion around this
area also will be repaired. The 6 inch
culvert that drains the wet area on the
mine access road and the one at the
loadout need to be permitted (see attached
NOV form). This revision must be
submitted before April 26, 1993. The
revised design shall be constructed no
later than May 31, 1993.
NOV C-93-029 was issued for failure to
have anon-clogging dewatering device.

Sediment pond E was approximately 1.5
feet from discharging through the top of the principal spillway. The pond was
not dewatering through the sized orifices to maintain a 10 year 24 hour storage
capacity. The dewatering device was frozen.
A clogged dewatering device violates Rule 4.05.6(3)(c).
