Enforcement Actions <br />The following icentifies enforcement actions taken during this inspection, the <br />required abatement and date of abatement for Use violation, previous violations <br />still requiring abatement and the termination of violations cited during previous <br />inspections. <br />4.05.6 Sedimentation Ponds. <br />120(2) <br />(j)(II) <br />121(2) <br />(i)(II) <br />(3) Sedimentation ponds and sedimentation treatment facilities shall <br />be designed, constructed and maintained to: <br />(c) Provide anon-clogging dewatering device or conduit <br />spillway to remove water storage resulting from inflow. The dewatering <br />device shall not be at a lower elevation than the maximum sediment storage <br />volume. Dewatering shall be achieved in accordance with applicable State <br />law; . . . <br />Abatement: <br />The mine will monitor the pond to ensure that the dewatering device is kept <br />open and functioning as designed. The operator will submit a certified report <br />which documents that the outlet was opened, that the pond did not discharge via <br />the emergency spillway, and specifies the date that the outlet was returned to <br />proper function.
