III. COMIYIENTS -COMPLIANCE <br />Below aze comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />A large portion of the crack was successfully repaired prior to this Phase I inspection; <br />however, farther to the east a separate section of the former highwall has cracked and <br />settled. There appeazs to be about three feet of total displacement. Pictures of the <br />settlement crack and offset aze shown in Photograph Numbers 9 and 10. This location <br />along the former north highwall will be excluded from the Phase I bond release, and <br />should be hand repaired as opposed to using heavier equipment to avoid additional, <br />unnecessary damage to the reclaimed highwall. <br />Also, significant erosion is occurring along the old scraper road that is above the shrub <br />plot and runs into the head of PM-13. A gully approximately 1 foot deep runs down the <br />old road towazd PM-13. A photograph of the unstable area above and to the west of PM- <br />13 is shown in Photograph No. 11. This area is unstable and will be excluded from the <br />Phase I bond release. <br />Another significant erosion feature is a very long rilUgully located along the northwest <br />side of the North Pit which runs for an estimated 2400 feet down to Armand Draw. This <br />azea of concern begins northwest of the shrub plot at the two-track road as a depressed <br />azea with spazse vegetation (probably a former access or haul road). As you walk to the <br />northwest from this location the elevation drops and the rill deepens. Another rill joins <br />this gully from the former haul road bench and the erosion extends down to Armand <br />Draw. The gully is identified on the 2006 Rill and Gully Survey. The gully is not <br />excessively deep but because of the length of the erosion and sparse vegetation in some <br />sections of the gully this azea is deemed unstable and will be excluded from the Phase I <br />bond release. Photographs of this gully from its start down to Armand Draw aze shown in <br />Photograph numbers 12 through 14. <br />There aze four other azeas noted during the inspection where erosion is occurring in the <br />form of rills and gullies but not to the extent that they will be excluded from the Phase I <br />bond release. These areas should be monitored for additional erosion and stabilized by <br />doing hand repair and reseeding if necessary. The first location is in the southern azea <br />below the two-track road a couple hundred yazds down from the south perimeter of the <br />North Pit. Several rills channel together and one was measured up to 1.5 feet deep. A <br />photograph of this azea is shown in Photograph No. 15. A second location is above and <br />below the start of the two-track road that leads up to the southern end of the North Pit. <br />Several gullies in this general area have been repaired above and below the road and are <br />shown in Photograph No. 2. The third location noted is immediately south of light-use <br />road above PM-10. A photograph of this location is given in Photograph No. 16. The <br />final location is below the old scraper road east of the shrub plot. Two significant <br />pazallel rills extend all the way down to a former haul road bench above the light-use <br />
