III. COMMENTS -COMPLIANCE <br />Below aze comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />long-term stability of Post-Mine Channel PM-13. A photograph of the unstable area <br />southeast and directly adjacent to PM-13 is shown in Photograph No. 6. These unstable <br />areas associated with the PM-13 channel will be excluded from the Phase I bond release. <br />At the upper section of PM-10 the channel does not have a trapezoidal configuration with <br />3.0:1 sideslopes as indicated by the design. There is too much riprap stockpiled on the <br />uphill side of the channel preventing water from flowing into the channel. This has <br />resulted in gully formation on the uphill side of the channel which has been repaired in <br />the past. PM-10 should be reconstructed to a trapezoidal configuration with <br />appropriately placed riprap to allow water to flow into the channel more easily. <br />Photographs of upper PM-10 are shown in Photograph Numbers 7 and 8. This small <br />section of the upper PM-10 channel should be reconstructed and will be excluded from <br />the Phase I bond release. <br />Backfill & Gradin <br />The majority of the reclaimed area of the North Pit was stable. Surface runoff control <br />appears adequate; however, there are several areas where rills and gullies have formed <br />and should be monitored and hand repaired. There aze three specific areas that are <br />erosionally unstable and will be excluded from the Phase I bond release as discussed <br />below. These locations are in addition to the excluded areas described above for the <br />light-use road, PM-10 and PM-13. <br />Observations were made throughout the inspection with regard to approximate original <br />contour and erosional stability of the reclaimed landscape. Based on observations made <br />during this and previous inspections, the reclaimed areas have been restored to the <br />approximate original contour of the pre-mining landscape. Comparison of the post- <br />mining topography map (Exhibit 20-2) with USGS 7.5 minute Quadrangle Map of Mount <br />Hams, Colorado indicates that two pre-mining drainages existed and were reconstructed <br />in the appropriate locations. These are the locations of PM-9 and PM-10. Some <br />differences were noted between original ground surface and post-mining topography at <br />both PM-9 and PM-10 in that the final configuration of each of these channels was <br />deeper than the original elevation of the pre-existing intermittent drainages. This <br />elevation difference can be seen on Exhibit DPost-Mine Cross-Sections but is not <br />considered a significant alteration of the approximate original contour since the drainages <br />were restored in the approximately the same place as they existed prior to mining. <br />Prior to this inspection the 2006 Rill and Gully Survey was reviewed and all areas <br />idenitified on the survey were inspected during this and previous inspections. One <br />feature is identified as a Settlement Crack located along the south facing north highwall. <br />
