Surface--The 3rd quarter monitoring for the surface <br />water monitoring sites indicated that of the 4 sites <br />monitored no flows occurred. <br />A comparison of the 1990, 1992 and current monitoring <br />indicates a substantially amount of variability but overall <br />the level of water in the wells has decreased. <br />AIR EMISSIONS: The Colorado Department of Health issued air <br />emissions permit 12RB802-3F for the refuse haulroad. The <br />permit limits the amount of refuse hauled over the road to <br />2,700 tons per day or 690,000 tons per year. <br />Emissions permit 12RB802-2F has been issued for the "D" portal <br />and supporting facilities. This permit limits raw coal <br />processing to 20,000 tons per day or 2.3 million tons per <br />year. Both of the above permits were issued on 10-19-93. <br />SPCC PLAN: The spill prevention control and counter measures <br />plan has not been revised for several years nor has an annual <br />review by a registered engineer been done since the last <br />revision to the plan. The plan was available and appears to <br />cover the storage of petroleum products stored at the mine. <br />POND INSPECTIONS: The 3rd quarter inspections of ponds listed <br />in the mine plan was completed on OS-30-93. No problems were <br />noted with any of the ponds at the time of the inspections. <br />Colorado regulations do not require annual inspections and <br />certifications on impoundments unless they are of a size which <br />would fall under the Mine Safety and Health Administration <br />regulations. Only impoundment DP-1 meets this size criteria. <br />The annual certification on this impoundment was done on 10- <br />27-93. <br />Colorado mine regulations do require that a registered <br />engineer submit the results of the quarterly pond inspections <br />on an annual basis. This was not done. DMG issued Notice of <br />Violation (NOV) C-93-153 for failure to make the submittal of <br />the pond inspections. <br />CERTIFICATIONS: <br />Impoundments: The eleven designed impoundments have <br />all been certified by a registered engineer. The <br />dates of the certifications are as follow: <br />DP-1, PP-1, PP-2, RP-1, RP-2 and RP-3 all certified on <br />5 <br />
