directors of WFU found that Stanley K. Bazant, vice president <br />of the board, no longer holds that position. Merrill J. <br />Millet has assumed that position. Company personnel confirmed <br />that no other changes in ownership have occurred since the <br />October 1991 revision to the permit updating this information. <br />CERTIFICATE OF INSURANCE: The liability insurance for the mine <br />indicates that the correct amount of coverage is provided. <br />The current policy expires in January 1999. <br />BOND: In October of 1991 the bond was reduced from <br />$6,719,541.00 to $5,264,028.00. Due to revisions since that <br />date the current total bond amount is $5,386,597.00. During <br />the inspection a concern was raised because there was no <br />concurrence from OSM for the bond reduction. Further research <br />revealed that OSM must give concurrence for a bond reduction <br />which releases land but concurrence is not required from OSM <br />when the bond is reduced as a result of an adjustment to the <br />bond where no release of lands is involved. <br />BLASTING: There is no surface blasting conducted at this mine. <br />COLORADO DISCHARGE PERMIT: Permit CO-0038024 has been issued <br />to Western Fuels Utah, Inc. The permit expires on December <br />31, 1993. The company has applied for a new permit but had <br />not received it at the time of this inspection. <br />A review of the monitoring of the discharge points found that <br />point 029A, which is a discharge of mine water, has compiled a <br />history of noncompliance with the permit requirements. This <br />particular monitoring point has now been replaced by discharge <br />point 026A but the source of the discharge remains the same, <br />mine water. The biological monitoring at this discharge point <br />requires a plan be submitted to the Health bepartment if the <br />discharge is not in compliance with the permit. The company <br />has done this and is currently awaiting a response from the <br />Health Department. <br />WATER MONITORING: <br />Ground--There are currently 18 wells which are being <br />monitored on a quarterly basis at the mine. The water <br />level is being monitored on all 18 wells with quality <br />being checked on only 1 well, QAL-5. The 3rd quarter <br />monitoring report indicated that all required <br />monitoring had been conducted. <br />4 <br />
