III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />Dust control <br />The longwall is currently shut down and during the inspection no coal was hauled <br />to the wash plant. The access road to the mine was noted to be watered several <br />times during the inspection. The longwall is anticipated to start up again next <br />week. <br />Rail Loadout Breaker Culverts C-7, C-18, C-7 and C-4 were clear and <br />functioning in this area. <br />Sewage Treatment Plant <br />Ditch D-17 was flowing with water from the sewage treatment plant. The culvert <br />and gabion combination C-5 and G-1 was functioning. Mud dogs were noted in <br />the outflow in ditch D-17. <br />Ciruela Canyon and Coal Waste Pile <br />The lower portion of the waste pile had been mulched and seeded. Culvert C-23 <br />serving to pass the Ciruela Canyon flow under the railroad embankment was <br />clear and functioning. Ditch D-18 contributing flow to Pond 004 was clean and <br />functioning. Ditch D-15 was clean an functioning. Gabion G-2 was clear and <br />functioning; it does not appear that this gabion had any flow this week even <br />though 3 inches of rain had fallen the past weekend. Ditch D-14, that is the 100 <br />year diversion for the coal waste pile, was clear and functioning. Ditch D-12 was <br />clear and erosionaly stable. <br />2 <br />
