2 J <br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />There were no problems with any of the small area exemptions. Straw bates were in <br />place. <br />The seep above the portals, along the access road to the water tank bench is still wet. The <br />west seep on the east side of the water tank bench has dried up. The seep just to the east <br />of that seep is flowing a little. The flow needs to be channeled into the drain pipe for the <br />west seep so that water does not flow behind the bench area. There is still a seep along <br />the main haul road between turns 10 and 11. <br />Topsoil Stockpiles <br />There were no problems at the coverfill topsoil stockpile, the gob pile topsoil stockpile <br />and the two topsoil stockpiles adjacent to pond B. At the main topsoil stockpile, the straw <br />bales need to be replaced soon. Also, the top of the pile needs to be reseeded. <br />All of the diversion ditches were functional. There was no evidence of gullying. <br />Facilities <br />The construction of the vent shaft has been completed. The operator will have the fan <br />structure assembled sometime in July. The muck on the bench outslope will be pulled <br />back later. The bathhouse and sewage treatment system construction will also be done <br />soon. There were no problems with any of the facilities. <br />Refuse Pile <br />The operator has not spread and compacted the vent shaft construction muck yet. The <br />Division has requested that the operator supply geotechnical information on the muck <br />before it is spread and compacted. <br />The operator continues to truck out coal refuse to the Cameo Mine. <br />The underdrain was exposed. The diversion ditches had sufficient capacity. The operator <br />continues to add subsoil to the refuse pile outslope. There was a very small area where a <br />little water had ponded. The amount of ponded water was negligible. <br />2 <br />
