s <br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection, conducted by Joe Dudash of the Colorado Division of <br />Minerals and Geology. Bill Beaz represented BowieResources. The weather was dry <br />during the inspection but had been wet in recent days. <br />Sins and Markers <br />Mine ID signs were up at the appropriate places and contained the correct information. <br />Surface disturbance markers were also up: Topsoil stockpile signs were also present. <br />Roads <br />The paved train haul road and the graveled gob pile haul road were in excellent <br />condition. The access road to the water [atilt bench was in good condition, even at the <br />seep area. The light use roads were dry and passable. <br />H rolo <br />Pond B is in need of cleaning soon. The sediment delta is close to the primary inlet. The <br />operator is waiting for the pond to dry out before they clean it. However, the cleaning <br />needs to be done soon, whether the pond is dry or not. The water level in pond C was <br />about one foot above the primary inlet. Pond D was dry. All of the spillways appeared to <br />be operational. All of the. embankments appeared to be stable. <br />A new culvert has been added to the refuse pile, where the haul road enters the refuse <br />pile's second lift. The ditch that receives the outflow is somewhat steep and may need <br />erosion protection. The operator was in the process of repairing a portion of the fill slope <br />adjacent to the riprapped ditch D-C 13, just above turn 6 of the main haul road. The water <br />had jumped the ditch and eroded the slope a little. The riprap in the ditch is being <br />repositioned as well. The inlet to culvert C-817 needs cleaning although it is still <br />functional. On the east side of the portal bench, the coal stockpiles are getting a little <br />close to the inlet to culvert C-CS and the outlet to culvert C-C4. This area has been a <br />problem before because of the proximity of the coal to the culverts. This area must be <br />watched closely. The culvert at the top of the access road to the water tank bench needs <br />cleaning. There were no concerns with the other culverts and ditches. <br />
