III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />Support Facilities <br />Facilities demolition has been largely completed within the South Mine wash plant vicinity, [he RSRDA, <br />the conveyor corridor below Transfer #2, and the North Portal Area, as well as the previously reclaimed <br />South Fan and 2-West Portal Sites. A relatively small quantity of metal demolition debris remains on the <br />top of the RSRDA and in a couple piles within the wash plant azea, and another pile remains at the rail <br />loadout. Some intact concrete foundation remains in the wash plant azea, associated with the raw coal <br />conveyor tunnel and the escapeway structure. The power line segment to the South Fan site is still in <br />place. <br />Topsoil <br />The soil evaluation report for replaced topsoil and subsoil associated with reclamation at CRDA-1, CRDA- <br />2, RSRDA, and the North Portal (topsoil only) has not yet been submitted to DMG, but a portion of the <br />mapping associated with the report has been completed. Thereport, and appropriate revisions, are to <br />address issues specified in the inspection report of 4/16/02. <br />Stockpile 3 soils had been recently spread on the final graded portion of the North Portal facility azea. <br />RSRDA outslopes had been recently covered with soil obtained from the approved soil borrow area, <br />supplemented by the 6" soil cover that had previously been placed on the RSRDAoutslopes as temporary <br />soil cover. Top-dressing soil within a relatively small area on the lower slopes of the RSRDA at the south <br />end appeazed to contain a high percentage ofshaley material, and suitability appeazed questionable. <br />Operator indicated that they would assess the soils in that location and take remedial measures as <br />appropriate, prior to revegetation. <br />General Mine Plan Compliance <br />Compliance with the approved reclamation schedule (Figure 14-1) was assessed. In summary, reclamation <br />tasks have to date been completed on or ahead of schedule. The only appazent exception is that the <br />RSRDA upper diversion is scheduled to be revegetated by the end of the current quarter, but this appears <br />to be erroneous. Permanent revegetation of the reclaimed diversion should be conducted during the <br />normal seeding period in late fall, 2002. <br />North Portal Area--All structural demolition/removal was to have been completed by the end of 2001, <br />with the exception of the Coal Creek dip section (end of 2002), Powder and cap magazines (end of 2002), <br />miscellaneous equipment (3rd QTR 2002), and substation (retained to support loadout operations). All of <br />the specified demolition and removal has been completed, including the items scheduled for completion in <br />the 3`" and 4a' quarter of 2002. Regrading (and presumablytopsoiling) is to be completed by the end of <br />2002, under the approved schedule. Grading operations are well underway and will be completed during <br />the summer of 2002, well ahead of schedule. <br />CRDA-1 and Coal Creek Permanent Diversion Channel--Final reclamation including permanent <br />seeding was to have been completed by the end of 2002 under the approved schedule. Final reclamation <br />of the pile and vicinity, including [he permanent diversion channel was completed in April 2002, ahead of <br />deadline. The temporary road extending from Haul Road 5 to the top of pile has been left in place andis <br />scheduled to be reclaimed during 3`d or 4s' quarter of 2004. <br />
