<br /> <br />In July, 1985, the Board suspended the mining permit for 30 days, pending <br />American Fuels obtaining additional funding for the required bond. In August, <br />1985, the Division learns the Union Indemnity Insurance Co., holder of the <br />Division's performance bond, was being liquidated by the State of New York. <br />Numerous hearings, letters legal actions result in American Fuels being forced into <br />bankruptcy on February 25, 1986, leaving the Division with the task of reclaiming <br />the New Pryor Strip Mine without any bond money to perform the work. <br />The IML program bid out the reclamation work for the New Pryor mine and in <br />October, 1991, the project was completed at a cost of $61,900. <br />Are there any pre-law or pre permit mining related disturbances? <br />Pre-law dismrbances include some subsidence features from old underground <br />mining workings, old building foundation remnants, and small piles of coal waste. <br />Are there any non-mining related disturbances created within the permit boundaries by <br />third parties (landowners, county road crews, oil and gas drilling contractors, railroad <br />crews, etc..)? <br />There are no known disturbances created by third parties. <br />Describe how the site is marked or identified. Does sufficient informatiot: exist to direct <br />interested persons to DMG? <br />Currently, there are no signs or markers that identify the site as a reclaimed coal <br />mine, nor are there any signs that direct any interested parties to the DMG offices. <br />(ii) Whether, and to what extent, there exist on the site impoundments, earthen <br />structures, or other conditions that pose, or may reasonably be expected to develop <br />into, imminent dangers to the health or safety of the public or significant <br />environmental harms to land, air, or water resources. <br />Are there any highwalls that have not been totally reclaimed? If so, describe the extent, <br />geologic composition and the remoteness (access) of the highwall. <br />All highwalls have been reclaimed and blended into the natural topography. <br />Describe any protective structures (fences, guardrail, etc) safeguarding the <br />highwall. <br />There are no remaining highwalls, therefore this question does not apply. <br />2 <br />
