As with any specific <br /> development proposal, some of the drawing requirements included in Table 6 <br /> may not be applicable to a specific PUD mining proposal. It is the responsibility <br /> of the applicant to demonstrate that a given requirement is not applicable. <br /> Section 7. CRITERIA FOR APPROVAL in addition to the Criteria of Table 7 of the Teller <br /> County Land Use Regulations for a PUD the following criteria for a PUD in the CCMOD <br /> for mining must be met. <br /> 7.1 Application is complete - The application must be determined to be complete. <br /> 7.2 Critical areas. The proposal will not adversely impact any critical areas. <br /> 7.2.1 Historic Sites standard. The applicant may consult with and consider on <br /> a voluntary basis the recommendations of the City of Victor and City of <br /> Cripple Creek and the State Historic Preservation Officer (SHPO) with the <br /> objective of evaluation of relocating historic structures that may be <br /> impacted by the proposed operations. The County may consider <br /> "provisional historic status" for existing operating mining structures to <br /> remain rather than being removed as part of reclamation of a site. <br /> 7.2.2 Wildlife Habitat standard. Where threatened or endangered species <br /> habitat is identified, compliance with applicable federal regulations shall <br /> be demonstrated to the satisfaction of the Teller County Planning <br /> Department (CDOW or USFWS affirmation of the compliance is a suitable <br /> demonstration). <br /> 7.2.3 External Effects and Environmental Quality shall comply with local, state, <br /> and federal standards. "External effects" include noise, dust, fumes, <br /> odors, blowing or flowing materials, glare, heat, and vibration (including <br /> but not limited to that caused by blasting). External effects shall not <br /> exceed standards established in state or federal law and incorporated in <br /> the PUD approved by Teller County. <br /> 7.2.4 Noise standard. The operations shall comply with applicable State and <br /> federal standards. Noise levels other than those caused by equipment <br /> required for safety shall not exceed at the DNR permit boundaries and at <br /> CCMOD boundaries the maximum levels contained in State law (See <br /> Colorado Revised Statutes 25-12-103 et. seq.) Maximum level shall be <br /> based on the use or zoning on the adjoining property, whichever provides <br /> the greater level of protection to the adjoining property. For the purpose of <br /> determining the maximum allowable level, adjoining agricultural land shall <br /> meet the standard for residential use or zoning, whichever provides the <br /> greater level of protection for the adjoining property, unless the property <br /> owner(s) of any such property located outside the Mining Area agrees to a <br /> less stringent limit, in which case the modified limit applies on that <br /> landowner's property. Where state law allows higher noise levels for <br /> construction, such higher levels for construction related-noise shall be <br /> CCMOD - Effective May 25, 2000 15 <br />
