Hartley, acting mill manager for Goid Hill Mill) <br />on charges of mining without a permit at the Mogul Tumtel. Authenticity of <br />certain documents presented by M1.RB Staff challenged by T. We stated <br />in part, "!t is difficult to escape the impression that the behavior exhibited by this <br />operator has paid off. Misrepresentations, evasions, outright lies, simple lack of <br />performance -all have hero rewarded by deferral of costs and issuance by the State of <br />continued sanction as operators of a `milling facility' which bas ao legal feed stock, <br />hence ao ideatitrable legitimate propose. ... Document lists <br />six (ti) occurrences of illegal water and/or tat7ings discharge in four (4) years, and seven <br />(7) occurrences of tailings pond freeboard inadequacy as noted on inspection reports <br />batwenn June '94 and November '95. <br />15 Nov. '95 DMG (M. Long) letter to COM, Inc. (G. Fraser) citing reason-to-believe a violation <br />for failure to complete liner repairs by specified date (1 Nov. '95) and scheduling <br />a hearing December 13 - 14, 1995. <br /> <br /> <br />16 Nov. '95 DMG (A. Sorenson) hr to COME (R.
