<br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />culvert C-C5. The operator was planning on building a structure around the culvert inlet so that the <br />problem would not happen again. <br />The operator has brought in equipment to begin construction of the relocation of pond B. Silt fence <br />was installed in the azea down gradient of the construction site before grubbing operations began. <br />However, the silt fence could have been installed better. Work was stopped until the silt fence was <br />properly installed. In addition, silt fence needed to be installed azound the contractor's staging area. <br />This work was also done by the operator before work resumed. <br />Finally, one bale needs to be replaced on the road to the coverfill stockpile. The straw bales at the mine <br />site entrance, at the coverfill pile and at the pumphouse were in place and functional. <br />Topsoil Stockpiles <br />There were no signs of erosional gullying on the main topsoil stockpile, the two small topsoil <br />stockpiles neaz pond B, the gob pile topsoil stockpile and the coverfill topsoil stockpile. Topsoil signs <br />were present. Diversion and collection ditches were functional as were straw bales for sediment <br />control. The main topsoil pile and the two piles near pond B were well vegetated. The other topsoil <br />piles were moderately vegetated. <br />Gob Pile <br />There were some gob piles on top of the gob pile, drying out before being spread and compacted. <br />There was positive drainage on the gob pile top. There was no standing water on the gob pile top. The <br />upland diversion ditch and the lateral collection ditch were functional. The upper end of the underdrain <br />was exposed, as designed. The road culvert and water bar were functional. <br />Facilities <br />There were no problems observed with any of the facilities. There were no leaks at the fuel barn azea. <br />There was no problem with fugitive dust. <br />
