~, <br />I11. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a complete oversight inspection. Joe Dudash represented the Colorado Division of Minerals <br />and Geology. Henry Austin represented the Office of Surface Mining. Bill Beaz represented Bowie <br />Resources Limited. It had been raining a couple of days before the inspection. <br />Roads <br />The paved haul road was in good shape, as was the gob pile haul road. The access road to the utility <br />bench was also in good condition. All roads were passable. Road berms were up at the appropriate <br />locations. <br />Siens and Mazkers <br />Mine ID signs were present at the required locations and contained the correct information. Surface <br />disturbance mazkers were up azound the disturbed azeas. <br />Hvdroloev <br />There were no dischazges from any of the ponds. Due to the recent rains, the water in ponds B and C <br />appeazed to be murky. Pond D was nearly dry. The water level in pond B was just above the primary. <br />In pond C, the water level was 6 inches below the primary. All of the pond embankments appeazed to <br />be stable. All pond spillways were functional. The riprap in the ponds' emergency spillways was intact <br />and stable. All gate valves were closed and showed no leakage. <br />All of the culverts and ditches were functional, although a few maintenance problems were present. <br />Ditch D-C 16, at tum number $ in the paved haul road needs maintenance and a small amount of coal <br />near the ditch needs to be picked up. A portion of ditch D-C1, behind the substation on the utility <br />bench, needs some maintenance as well. A straw bale needs to be replaced in the end of the conveyor <br />corridor ditch at turn number 5 of the paved haul road. <br />The inlet of culvert C-B 17, which leads to pond B, needs some cleaning. The outlet of culvert C-G4, <br />which goes into the east side of pond D, needs cleaning as well. During the inspection, some coal from <br />the portal bench coal stockpile had slid over the inlet to culvert C-C5. The operator was pumping out <br />the water that accumulated behind the slide and draining it to ditch D-C6, where culvert C-CS drains <br />to. In addition, the coal stockpile was being moved for access to and the cleaning out of the inlet to <br />
