The pit was reclaimed into a reservoir pond a <br />number of years ago. A slurry wall has been constructed around the entire pond roughly 40 <br />feet deep to intersect bedrock. The total length of the slurry wall was estimated by the <br />operator to be one mile long. Water can be released into the reservoir pocid from the south <br />branch ditch when there is "free water." The operator can control water entering the <br />reservoir from gates installed along the southbranch ditch. The operator can also control <br />the amount of water to be released to the St. Vrain River. The operator stated that the <br />reservoir can hold 575 acre-feet of water, and takes roughly 5 days to fill. <br />A review of the permit file shows that the current final land use after reclamation is <br />agricultural. Since the area will be used as a developed water resource (water storage <br />facility) , it does not appear that the planned post mining use of agriculture will be <br />applicable. The Division considers construction of a water reservoir to t,e a 'significant <br />change' to the reclamation plan, which as defined by Rule 1.1(6) requires that an amendment <br />to the permit be obtained from the Division to change the final land use. The operator will <br />need to file an amendment to the permit to change the final reclaimed land Lse to "Developed <br />Water Resource." The amendment should include a map showing the permit boundary and the <br />boundary of the slurry wall. The operator will also need to submit a certified construction <br />report detailing the as-built" condition of the slurry wall. See page 4 for additional <br />detail. <br />In summary, The Division reviewed the Lyons- Rockin' wP file to ensure tY,e operator is in <br />compliance with the mining and reclamation plan. Based on the Division's inspection and <br />review of the file, the following information must be submitted to the Livision to be in <br />compliance with the Rules and Regulations; <br />• File an amendment to the permit to change the final reclaimed land u:ae to "Developed <br />Water Resource." The amendment should include a map showing the permit boundary and the <br />boundary of the slurry wall. The operator will also need to submit a certified <br />construction report detailing the as-built" condition of the slurry wall. <br />• Submit an as-built" design for the low water crossing installed on the St. Vrain <br />River. A reclamation plan will also need to be provide (if the structure is to be <br />removed). This can be included in the amendment application noted above, or as a separate <br />technical revision. <br />• Update the mining and reclamation plan with the topsoil replacement d>_pth, actual seed <br />mix used on site, and augmentation plan.
