Page 4 <br />Hard Rock/Metal Mining Rule 1 <br />shall be exempt from the requirements applicable to Designated Mining <br />Operations, unless they have a potential to produce acid mine drainage in <br />quantities sufficient to adversely affect ~ any person, property or the <br />environment. It shall be the burden of the Operator or Applicant to <br />demonstrate to the satisfaction of the Office that such potential does not exist. <br />(f) Designated Mining Operations shall be identified with a "d" <br />suffix, (ie., 110d or 112d). <br />(15) "Environmental Protection Facility" means .a structure which is <br />identified in the "Environmental Protection Plan" as designed, constructed and <br />operated for control or containment of designated chemicals, acid mine drainage, or <br />toxic or acid-forming materials that wrll be exposed or disturbed as a result of mining <br />or reclamation operations. <br />to3 (16) "Environmental Protection Plan" means a plan submitted by a <br />Designated Mining Operation for approval as part of the Operator's or Applicant's <br />permit for such operation for the protection of human health, property or the <br />environmem in conformance with the duties of Operators as prescnbed by the Act and <br />these Rules. <br />(17) xtraction" means the removal of minerals and/or overburden from <br />places of natural occurrence to surface locations. <br />(18) "Extractive Metallurgical Processing" means the production-scale <br />process of extracting metals of value from mineral ore, or waste water treatment for <br />metals removal It does notinclude laboratory analyses, metaIlurgicaltesting,potable <br />water treatment, prospecting activities, or other activities which involve only <br />incidental, or minima], use of designated chemicals and which do not pose a threat to <br />human health, property or the environment. <br />(19) acilit "means the combined "activities" occurring on the affected <br />]and. <br />t2ts (20) "Failure or Imminent Failure" means, for the purpose of emergency <br />notification response, the actual or pending release of an unauthorized or unpermitted <br />material or liquid from- any impoundment, embanlanent, or from any other <br />containment facility or system where such release poses a reasonable potential for <br />danger to human health, property or the environment. <br />
