Page 7 <br />Hazd Rocls/Metal Mining Rule 1 <br />to3('0 (30) eral" means an inanimate constituent of the earth in a solid, liquid, <br />dr gaseous state which, when extracted from the earth, is useable iu its natural form <br />or is capable of conversion into a useable form as a metal, a metallic compound, a <br />chemical, an energy source, or a raw material for manufacturing or construction <br />material For the purposes of this article, this definition does not include coal, surface <br />or subsurface water, geothermal resources, or natural oIl and gas together with other <br />chemicals recovered therewith, but does include or1 shale. <br />to3(s) (31) "Mining_Operation" means the development of extraction of a mineral <br />from its natural occurrences on affected land. The term includes, but is not limited <br />to, open mining and surface operation and the disposal of refuse from underground <br />and in situ mining. The term includes the following operations on affected lands: <br />Transportation; concentrating; mrlling; evaporation; and other processing. The term <br />does not include: The exploration and extraction of natural petroleum in a liquid or <br />gaseous state by means of wells or pipe; the development or extraction of coal; the <br />extraction of geothermal resources; smelting, refining, cleaning, prepazation, <br />transportation, and other off-site operations not conducted on affected land. <br />(32) "Modification" means any amendment or revision of any previously <br />granted permit, including permit transfers, increases or decreases of the amount of <br />financial warranty required by the Boazd, and declarations regarding temporary <br />cessation, which is either: <br />(a) initiated by the Boazd pursuant . to Subsection 3.3.2 as <br />necessary to bring the operation into compliance with the provisions of these <br />Rules or the Act, or <br />(b) the subject of a petition for a formal hearing granted by the <br />Boazd pursuant to Section 34-32-114 of the Act. <br />(33) "Office" means the Office of Mined Land Reclamation within the <br />Division of Minerals and Geology (DMG). <br />(34) "Off-site" means an azea defined by a proposed or existing <br />construction project, where such project azea does not include the site of construction <br />material extraction nor is it immediately adjacent to such site of extraction. In relation <br />to an extraction operation, it means that area outside the pemut azea. <br />103(9) (35) "Open Minine" means the mining of minerals by removing the <br />overburden lying above such deposits and mining directly from the deposits thereby <br />exposed.
