Page 3 <br />Hazd Roclc/Metal Mining Rule 1 <br />The opinion must demonstrate cleazly and fully, without significant disclaimers, that <br />the financial tests have been met by the Financial Warrantor. <br />11 s(z) (10) "Complex Application" is an application which may require the Office <br />to involve additional professional staff or outside professional or agency expertise, <br />and is beyond what the Office considers to be a typical application review process for <br />the majority of applications received. <br />110(8) <br />(11) Reserved <br />(12) "Custom Mill" is a m~71 that is not engaged in the processing of ore <br />from any permitted mine that is owned or under common control with the milling <br />facility or the entity operating the milling facility. An Applicant or Operator who <br />intends to mffi ores from other mining operations must submit adequate information <br />to demonstrate that waste (material or stream) from such ores will be processed or <br />disposed of in a manner to protect human health, property and the enviromnent. <br />"Custom MiIl" does not include mills regulated by the Radiation Control Division of <br />the Colorado Department of Public Health and the Environment under Part 18 of <br />Rules and Regulations Pertaining to Radiation Control <br />(13) "Designated Chemicals" aze toxic or acidic chemicals used.within the <br />permit area in extractive metaIlurgical processing, the use of which, at certain <br />concentrations, represents a potential threat to human health, property or the <br />environment. <br />ll2.s (14) "Designated Mining_pO eration" means a mining operation at which: <br />(a) designated chemicals used in metallurgical processing aze <br />present on-site; or <br />(b) toxic or acid-forming materials wfIl•be exposed or disturbed as <br />a result of mining operations; or <br />(c) acid mine drainage occurs or has the potential to occur due to <br />mining or reclamation activities. <br />(d) The various types of Designated Mining Operations aze <br />identified in Section 34-32-112.5, C.R.S. 1984, as amended. <br />(e) Metal mining operations, permitted under Section 34-32-110, <br />C.R.S. 1984, as amended, which do not use or store designated chemicals, . <br />
