<br />Riverside Reservoir and Land Company <br />Riverside Irrigation District <br />Farmers State Bank of Brush <br />Case No. 90-CW-189 <br />Page 12 <br />(4) A refill decree, Reservoir Priority No. 24R, <br />with a priority date of 12:00 p.m., December 31, 1929, which was <br />decreed on June 8, 1965. This decree awarded the right to <br />measure up to an additional 56,325 acre-feet of water into <br />Riverside Reservoir for the purpose of refilling it, subject to <br />the capacity of the reservoir and its inlet canal, to be diverted <br />through the inlet canal at a rate not to exceed 1,000 cfs. This <br />refill decree shares a common priority date with several other <br />refill decrees in Water District No. 1. <br />The amount of water diverted pursuant to the Headley Re- <br />charge and Augmentation Project which is stored in Riverside <br />Reservoir in any water year shall be deducted from the amount of <br />water that could otherwise have been diverted pursuant to the <br />most senior priority of those listed in subparagraph C.(1). <br />through (4) above, that has not been fully satisfied during that <br />same water year and which would have otherwise been in priority <br />and operating at the time such water was diverted and stored. <br />29. Limitations oa diversions and releases: <br />Riverside and the Bank may only divert water pursuant to the <br />water rights for the recharge ponds for the Headley Recharge and <br />Augmentation Project if there is storage capacity available in <br />the Recharge Ponds for the water diverted at the Riverside Canal <br />headgate at the time of the diversion; provided, however, that <br />Riverside and the Bank may temporarily hold water diverted for <br />the Headley Recharge and Augmentation Project in Riverside or <br />Wildcat Reservoir, as described above, prior to releasing the <br />water to the Recharge Ponds. Riverside and the Bank shall not be <br />permitted to release water out of Riverside or Wildcat Reservoir <br />for use in the Headley Recharge and Augmentation Project under <br />any priority other than those awarded in Case No. 90-CW-189. <br />30. Determination of recharge credits: <br />In order to accurately determine the amount and rate of <br />recharge into the underlying alluvial aquifer, the following <br />rates and volumes must be quantified: <br />A. Deliveries from the Riverside system; <br />B. Losses in the Riverside Canal from the Bruce Weir <br />to Antelope Draw; and losses in Antelope Draw to the Recharge <br />Ponds; <br />
