Conditions of temporary storage: <br />In order to preserve the historical return flow regimen <br />attributable to the operation of Riverside Reservoir and its <br />inlet and outlet canals, any water stored for the Headley Re- <br />charge and Augmentation Project will be subject to the following <br />terms and conditions (No parallel criteria are proposed for <br />Wildcat Reservoir since it has no associated historical return <br />flow regimen): <br />A. The water so stored shall be separately accounted <br />for by Riverside as the "Recharge Account." The amount of water <br />delivered into or released from the Recharge Account will be <br />quantified on a daily basis. <br />B. The amount of water credited to the Recharge <br />Account shall be decreased by 0.33 per day to account for <br />seepage and evaporative losses. <br />C. The following water rights listed in order of <br />seniority are decreed for storage in Riverside Reservoir: <br />(1) A water storage right, Reservoir Priority No. <br />24, with an appropriation date of April 1, 1902, which was <br />decreed on January 15, 1914, for 700 million cubic feet of water <br />or 16,070 acre-feet for irrigation purposes, to be diverted <br />through the inlet canal at a rate of 500 cfs. <br />(2) A water storage right, Reservoir Priority No. <br />45, with an appropriation date of August 1, 1907, also decreed on <br />January 15, 1914, for 1,805 million cubic feet of water or 41,437 <br />acre-feet for irrigation purposes, to be diverted through the <br />inlet canal at a rate of 1,000 cfs. <br />(3) A water storage right, Reservoir Priority No. <br />77, usually referred to as the "rod decree," with an appropria- <br />tion date of October 25, 1910, also decreed on January 15, 1914. <br />The decree grants the right to a sufficient amount of water to <br />fill Riverside Reservoir, together with the water granted under <br />Reservoir Priority No. 24 and 45, to a specified depth above the <br />bottom of the outlet tubes. Subsequently, this storage right has <br />been made absolute to a depth of 33.55 feet above the bottom of <br />the outlet tubes of Riverside Reservoir, to be diverted at a rate <br />not to exceed 1,000 cfs from the South Platte River through the <br />inlet canal. The remaining portion of the conditional water <br />right awarded in the January 15, 1914 decree has been abandoned. <br />
