Minesite Inspection Narrative <br />Page 2 of 2 <br />This is an inactive mine slated to be reclaimed with work to commence this <br />summer according to representatives of the company and the Division. The permit <br />for this site expired 8/16/92, however the operator applied for a renewal on <br />2/19/92. <br />According to Dan Hernandez, the state of Colorado is attempting to change the <br />rules covering highwall elimination to allow certain existing walls to remain and <br />Energy Fuels wants to change the reclamation plan to allow approximately 200 <br />linear feet east of the Helen portal area to remain As of this date Colorado's <br />program still requires all highwalls be eliminated and the Raton Creek Permit states <br />that all highwalls be reclaimed. <br />Dismantling of production equipment has begun with items dismantled stored on <br />the pad at the time of this inspection. The shop, office and varioua other buildings <br />still are in place. According to Hernandez the landowner wants some of the <br />structures including the access road and warehouse to remain for his use. <br />Violation C-93-50 had been issued with an abatement deadline of 5/12/93 for <br />failure to post or maintain mine signs and perimeter markers. At the time of this <br />inspection the operator had not adequately abated this violation so the state of <br />Colorado issued Cessation Order CO-93-088 for failure to abate the violation on <br />6/10/93. <br />A portion of the highwall above the Animas portal area had failed and fallen on the <br />pad. Additionally it appears that more of the face is about to collapse unto the <br />pad. The Division had issued a Notice of Violation for failure to notify the Division <br />about this and required submittal of a plan to stabilize this area. As this plan had <br />been submitted and the operator met requirements the violation was terminated at <br />the end of the inspection. <br />The Division had previously written a Notice of Violation for storage of noncoal <br />waste in an unapproved area. This material had been disposed of by this <br />inspection and as a result the violation terminated at the end of this inspection. <br />Diversions for undisturbed drainage above the mine on both side of the canyon are <br />under violation for maintenance and on the south side above the substation for <br />never being constructed. During this inspection cleaning of the diversion parallel to <br />the haulroad across from the mine office was being done. Additionally some <br />maintenance had been done on the northern diversion. <br />
