III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />Using a flat, five foot long stick and an inclinometer, the Division checked several of the <br />construction dimensions of ponds J and K and compazed these dimensions to the designs. <br />In general, the constructed pond dimensions compared favorably with the design <br />dimensions. However, there were some apparent discrepancies that the consultant for the <br />operator will check out. <br />For pond J, the constructed pond inslopes were about 2H:1 V and the constructed <br />embankment outslopes were about 3H:1 V. The pond bottom approximated the design <br />dimensions. The pond embankment top width varied from 15 feet to 10 feet, with a lazge <br />extent of the pond embankment actually being incised into undisturbed land. The <br />elevation from the bottom of the pond to the primary spillway was about 2.7 feet, as <br />compazed to the design of 2 feet. The elevation from the bottom of the pond to the <br />emergency spillway was about 5 feet, one foot more than the design dimension of 4 feet. <br />The emergency spillway cross section was very close to the design of a 5 foot bottom <br />width and a 13 foot top width. However, the depth of the emergency spillway was closer <br />to 1.5 feet, rather than the 2 foot design depth. However, the 2 foot design depth includes <br />1.5 feet of freeboazd. The D 50 riprap size of 20 inches was about right, with a filter <br />fabric underlayment. <br />For pond K, pond inslopes were about the design requirement of 2H:1 V, although one <br />inslope measurement on the east side of the south constructed embankment was about <br />1.6H:1 V. Pond outslopes appazently do not approximate the design requirement of a <br />3H:1 V slope. On the south embankment, outslopes varied from 2.2H:1 V to 2.4H:1 V. The <br />west embankment outslope is about 1.SH: I V. The constructed pond bottom was close to <br />the design dimensions. From the pond bottom to the primary spillway invert was 1.7 feet, <br />more than the design of 1 foot. The distance from the pond bottom to the emergency <br />spillway invert was 3.8 feet while the design was 3 feet. The constructed emergency <br />spillway measurements compared favorably to the design measurements. The emergency <br />spillway design did not call for any riprap, and this was reflected in the field. The pond <br />embankment top width was right at 10 feet, the minimum required width. <br />There were two small slumps in the excavated south facing slope on the east end of the <br />new mainline earthwork cut. Water is seeping through, apparently from an irrigation <br />ditch above the highway. The seep water is less than a gallon a minute and is being <br />collected by the mainline ditch D- JI. <br />2 <br />
