III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />can not let the concrete sedimentation basins overflow into the pond unless the pond has been <br />sized for the additional water. <br />There is a low spot on the south side of the loadout bin. The low spot was formed when coal <br />spills were scraped up using a front end loader. The low spot does not drain to the sediment <br />pond. The operator will design and construct a drainage route so that the low spot can drain <br />appropriately. The straw bales at the entrance to the orchard road were in place. There is a low <br />spot on the south side of the sewage pond and the operator will build up that area so that runoff <br />from the bench does not flow into the sewage pond. <br />There were no problems with the remaining loadout facilities. There were no leaks at the double- <br />walled fuel tank or at the fuel facility adjacent to the shop. The shop fuel facility berm was <br />functional. <br />Highway Coal Stockpile <br />The operator is in the process of temporarily reclaiming this area. Excess coal was removed and <br />subsoil was graded over the area. The operator needs to seed and mulch the stockpile area. <br />The sediment pond had been recently cleaned out and was dry. The pump hose and the discharge <br />drainage pipe were in place. Pond inslopes were stable. <br />The two culverts under the railroad tracks were clear. The straw bales along the tracks were in <br />place. <br />Mine ID signs were up at the entrance to the site. <br />East Mine <br />Structural demolition continues at the east mine. Piles of scrap material and mine equipment <br />remain on the portal bench. Part of the ?000 ton coal bin on the warehouse bench and parts of the <br />crushing/screening plant on the crusher/screener bench remain to be demolished. The operator is <br />using the crusher/screener bench as a staging area to ship out the mine equipment and scrap. <br />
