III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />The two adits on the portal bench have been backfilled. There is still some coal waste on the <br />temporary coal stockpile just east of the 2000 ton coal bin. <br />There are some barrels at the fuel facility on the portal bench, at the waste oil facility on the <br />crusher/screener bench and at the former fire warehouse on the warehouse bench. Some of the <br />barrels contain petroleum products. These items will be collected and removed. The large waste <br />oil tank was empty. There is oil that has collected in the fuel facility basin on the portal bench <br />and this has to be disposed of properly, as well. Three dead birds were found in the oil at this <br />facility. <br />The roads at the east mine were in good condition, including the paved haul road, access roads <br />and light use roads. The main gate was closed but not locked. Mine ID signs were up at the <br />appropriate locations and contained the required information. Disturbed area boundary markers <br />were up at the appropriate locations around the mine site, as well. <br />The culverts and ditches at the east mine were functional, although two ditches will need <br />maintenance soon. The first ditch is the road ditch that lies to the east of the 2000 ton coal bin, <br />next to the road cut. The second ditch is the concrete ditch that is behind the former electrical <br />warehouse. Straw bales were in place around the drop culvert and at the back ditch outlet on the <br />crusher/screener bench. During the inspection, the operator touched up the ditch leading to the <br />drop culvert. <br />Ponds 1, 3 and 4 were dry, Pond 2 was nearly dry. The gated valves on ponds 1, 2 and 3 were <br />open while the gate valve on pond 4 was closed. Pond 4 is the NPDES point. The bin walls for <br />all four ponds appeared to be stable. Pond inslopes were also stable. Spillways were functional. <br />ROM Pile <br />There still is a considerable amount of run-of-mine (ROM) material remaining at the site. Some <br />of the material has been put into the vent shafts at the West Mine. More material will be put into <br />the shafts if the material already in the shafts settles. <br />The pond at the ROM pile was dry. The gated valve was closed. The pond embankment and <br />inslopes were stable. The embankment was well vegetated. Culverts and collection ditches were <br />functional. <br />There was no gullying at the topsoil stockpile. The topsoil sign was up. <br />
