III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado Division of Minerals <br />and Geology. In addition, Mitch Rollings of the Office of Surface Mining conducted a federal <br />oversight inspection of the state complete inspection. Basil Bear represented the operator, Bowie <br />Resources Limited, during a portion of the inspection. <br />Train Loadout <br />A fully loaded unit train was at the train loadout, waiting to be pulled out. A few coal haul trucks <br />unloaded during the inspection. There were no signs of fugitive dust at the loadout. The entrance <br />roads were in good condition. <br />The sediment pond at the loadout was dry. The bin wall appeared to be stable. The primary <br />discharge gate was closed. Both of the primary and emergency spillways were functional. The <br />upland diversion ditch had sufficient capacity. <br />Culverts, ditches and berms at the loadout were functional, although the bushes azound [he inlet <br />and outlet to culvert number 6 need to be cleared out. Map 8-3, Coal Storage and Loadout Area, <br />needs to be revised to add several hydrologic items. First, the private culvert that receives water <br />from mine culvert.number 6 needs to be added to the map. Currently, culvert number 6 and the <br />private culvert are shown as one culvert. Second, the Highway 133 culvert and the ditch located <br />just east of the truck exit need to be added to the map. Third, the drop culvert and the drain pipe <br />at the grizzly need to be added to the map. Finally, the SAE designation for the loadout bench <br />outslope needs to be narrowed on the map to just include the bench outslope. Currently, the SAE <br />designation is too wide on the map and includes part of the loadout bench, in addition to the <br />bench outslope. <br />The topsoil stockpile had an appropriate sign. Mine ID signs were up and contained the correct <br />information. Permit boundary markers were present. <br />The operator was washing down the conveyor belt line during the inspection. Some water was <br />leaking from the conveyor belt structure, flowing along the facilities road, and, then, was running <br />into the two concrete sedimentation basins located underneath the conveyor belt. The <br />sedimentation basins were intended to contain the washdown water but were overflowing. A <br />small amount of water was flowing into the western portion of the sediment pond, soaking into <br />the ground. The operator needs to fix the leak so washdown water does not run along the road. <br />Also, [he operator <br />
