,r <br />Page 41 <br />Construction Materials Rule 1 <br />(iii) plans for resumption of mining. <br />103(11)(c) <br />1.13.8 Five Year Term of Temporary Cessation <br />(1) Apermit granted pursuant to these Rules shall continue in effect <br />as long as: <br />(a) the mining operation is resumed within five (5) years of <br />the beginning of Temporary Cessation; or <br />(b) the Operator files a request for an extension of the <br />period of Temporary Cessation with the Boazd meeting the <br />requirements of Subpazagraph 1.13.5(3) and secures Board approval of <br />that request. <br />(2) The Board shall, when necessary, establish the commencement <br />of temporary Cessation to determine the start of the five (5) yeaz period <br />described in Subsection 1.13.8. <br />1.14 <br />l03(11)(d) <br />1.13.9 Ten Year Limitation for Temporary Cessation <br />In no case shall Temporary Cessation be continued for more than ten (10) years <br />without terminating the mining operation and fully complying with the <br />Reclamation Plan requirements of the Act and these Rules. <br />TE1L~dIN aTION <br />1.14.1 Permit Termination <br />(1) A permit granted pursuant to these Rules shall continue in effect <br />as long as: <br />(a) the Boazd does not take action to declare termination of <br />the life of the mine, which action shall require a sixty (60) day notice to <br />the Operator alleging a violation of the permit, the Act or Rules; or <br />
