ti ~. <br />Page 42 <br />Construction Materials Rule 1 <br />(b) there is a discontinuance of the mining operation with a <br />Temporary Cessation filing as provided in Subparagraph 1.13.5 or <br />1.13.7; <br />(c) there is no failure to submit the reports required under <br />Subsection 1.13.5 and 1.13.7; or <br />(d) there is no failure to comply with the requirements of <br />Rule 1.13.8. <br />(2) In the event the Operator is not in compliance with the <br />provisions of Subpazagraph 1.14:1(1), the Boazd shall provide a reasonable <br />opportunity for the Operator to meet with the Boazd to present the full case and <br />further provide reasonable time for the Operator to bring violations into <br />compliance. Such hearings and procedures shall be in compliance with the <br />requirements of Subsection 3.3.2; or at such hearings the Boazd may: <br />(a) declare termination of the life of the mine according to <br />the provisions of this Rule and after fmding a violation in accordance <br />with Subsection 33.2; or <br />(b) declare that a mining operation is in a state of <br />Temporary Cessation, establishing a commencement date, as necessary, <br />according to a review of the facts. <br />1.15 ANNUAL REPORT INCLUSIONS <br />(1) The Annual Report shall include all information specified on the <br />Annual Report Form, issued by the Office, and specifically: <br />(a) the Operator shall submit, together with the Annual <br />Report, an updated statement regarding the sufficiency of the value of <br />the Financial Warranty. Additional reasonable data to substantiate the <br />value of the existing Financial Warranty shall be provided if requested <br />by the Office or Boazd; and <br />
