-- <br />(Page 3) <br />MINE ID # OR PROSPECTING ID # M~3-758 <br />INSPECTION DATE 2/21/97 INSPECTOR'S INITIALS WHE <br />MINING OPERATION -Material crusher, conveyor belts, generator, fuel tanks, water trailer, shop <br />trailer and material stockpiles were located within the pit area. Topsoil stockpile was located in the <br />SW corner of the affected area. Stripped vegetation had been placed along the perimeter of the <br />affected area. All mining related activities appeared to be within approved areas; however, affected <br />area perimeter markers are required to verify that no offsite activities have occurred. Mine <br />personnel were working on the crusher. Material excavation and crusher were not active during <br />the time of this inspection. <br />HYDROLOGIC BALANCE -Disturbed area drainage is controlled by pit grading and location of <br />material stockpiles and sediment containment berms. Evidence of excessive offsite <br />erosion/sedimentation was not observed along the canyon rim, bordering the east side of the <br />affected area. Evidence of excessive erosion/sedimentation was not observed within the affected <br />area. <br />Fuels and lubricants are stored within the permit area. Lubricant from one 55-gallon drum had spilt. <br />Spilt oil was located in the NE corner of the affected area, behind the shop trailer. Spilt oil appeared <br />to have been absorbed into the ground, no evidence of oil spill escaping permit area was observed. <br />Contaminated ground was limited to 3' x 5' area. All fuels, lubricants and chemicals need to be <br />stored in a controlled manner, at a designated location, with adequate spill prevention and spill <br />containment controls. Spill containment controls typically include measures such as construction <br />of a containment berm surrounding each fluid storage area. Berm surrounding each fuel tank should <br />enclose sufficient area to ensure containment of volume equivalent to enclosed tank capacities. <br />Containment areas should be lined with an impermeable liner to ensure spilt fuel or fluids not escape <br />and degrade quality of ground and surface waters (Rules 3.1.6 and 3.1.7). Please note that the <br />financial warranty for the operation will be recalculated to include disposal costs for discarded <br />fluids, should they remain on site. Contaminated soil, from existing oil spill, should be disposed or <br />detoxified appropriately. <br />FINANCIAL WARRANTY -Changes to the Mined Land Reclamation Act, due to the passage of <br />Senate Bill 91-177 in 1991, included the removal of the 55000.00 bond cap for 11012) type <br />permits. All mine sites in Colorado are now required to be bonded for the actual cost of reclamation <br />if, in the case of permit revocation and bond forfeiture, the state were to put the reclamation work <br />out for competitive bid. Review and recalculation of the required bond for reclamation of this <br />operation will take place over the next few months. A detailed estimate of the recalculated cost, <br />based on the approved mining alld reclamation plans and conditions observed during the inspection, <br />will be forthcoming. <br />I & E Contact Address <br />NAME M.J.
